Hello everyone,

My fiance and I are in the process of gathering everything to send in to the U.S. Embassy in Islamabad (Pakistan) in order for him to schedule an interview for his K1 Visa. We had one question and thought we'd bring it to the table before we asked a lawyer (if necessary). Here goes:

My fiance (the applicant) is divorced. We sent in a copy of his divorce certificate during the USCIS I-129F process and were approved. When sending in necessary documents, aside from his divorce certificate, is it necessary to send in his marriage certificate as well?

My fiancee is divorced also. The package 4 said to bring marriage and divorce certificates. We took both, but they only looked the original divorce certificate and took the photo copy. They returned the marriage certificate ( which she had to apply and get it in hurry, got one in 2 weeks. since the original with her ex husband).

However, it is better to collect one and take it , in case. It is always have more documents than less. I am not sure about how can you get one in Pakistan quickly?

No, you can't get a divorce unless you were married. So the divorce decree establishes that the person was previously married.

The reason marriage certificates are on the list of requested documents are not as evidence of previous marriage. They are used primarily to track name changes, so the request is not generally applicable to men, first marriages or even women who have never used another name besides the one on their birth certificate.

Example where needed is when Mary Jones, marries then divorces John Smith, and her divorce decree mentions only John and Mary Smith being divorced. In this case Mary needs the marriage certificate to show that the Mary Jones on the birth certificate is the person who Divorced John Smith and is now filing a petition.

In short, anytime the maiden name isn't on the divorce decree, the female is going to need to provide the associated marriage certificate(s). For the petitioner, this is done at the petition stage. For the visa applicant, it's done at the NVC and/or Consulate stage.

Beneficiary who will go for K-1 visa interview in Pakistan is single and never married so he don't need to submit since he had such documents. Petitioner who is a US citizen already submitted the previous divorced decree to USCIS at the time of I-129F filing and it got approved and went to NVC and to embassy and now beneficiary needs to submit the packet 3.5 and the visa application DS-160. Once you received the packet 3.5 make sure to read each line carefully and in which they asked the visa applicant (not the petitioner) to submit list of documents. Adding extra documents which were not asked always make things more complex.

Correction : Your fiance in Pakistan who is a visa applicant is divorced and now he needs to submit the packet 3.5 then 'YES' he needs to submit his divorced decree and marriage certificate both original and English translation and must have NADRA issues divorced certificate.
