hi. im working on a visa for my husband, and the USCIS approved everything and sent it to NVC. the NVC sent us a few papers telling us some instuctions we need to do. it tells us about the affadavit of support? what is this? i have nothing in my name in the states. no bank account. this step is frustrating. how do I do this? and also court and police records? who needs these? myself, my husband, or both of us.? i hav3e been living in mexico for going on 4 years now.. can someone please give me some advice. i will really appriciate it. thank you-

Yes, you will need to supply an I-134 affidavit of support. If you do not have a US based income then you will need to find another US citizen or LPR to be a joint sponsor along with you. This is needed at both the K1 visa stage and for the Adjustment of Status after marriage in order to get a green card.

Also, if you have been working outside the US you may still need to have filed income tax returns. The US taxes on worldwide income. So do some checking as this will be needed for the I-864 Affidavit of Support. You may not need to pay any tax if you paid Mexican income tax. But you may still be required to file.

Do some reading in the Mexico, Latin America, South America forum to learn specifics about what you need to prepare for the interview in CDJ. The instructions are for the immigrant. They need to supply the criminal and medical information.

Do some reading, it seems that you have a lot to learn to obtain the visa without problems or delays.

The financial support of the immigrant is one of the big "can;t get around" issues. You will need to either move to the USA and get a job, or as mentioned find a US based co-sponsor to stand guarantor for your fiance/husband.

Only the immigrant needs police records.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

The co-sponsor will need the same things as you; I-864, tax filings, proof of income and proof of US citizenship or greenncard. Where they live don;t matter.

If the husband files jointly with the wife, the wife will need to file I-864A.
