Hi all, I have just applied the CR-1 petition for my spouse. He is a Mexican citizen residing in Vancouver, Canada as a permanent resident there. I am curious to know if our application will be processed as a Mexican or Canadian one? Which consulate will the interview be at?

Question 22 what dd you put down as the Consulate of interview. And for your husband what address did you put don for where he lies?

I thought I read in a thread awhile back that the interview is in whatever country they're physically in....not necessarily legally in?

We have more-or-less a similar situation. My husband was born in Italy, moved to Switzerland at 10 and became a citizen there, then lived in the US on visas and now we live together in The Netherlands.

According to NVC, his "Foreign State Chargeability" is Italy. However, all proceedings/interviews will take place in The Netherlands. If we move to Italy or Switzerland in the next few months, they can process the rest of his case there. We were assured it's not a big deal.

For your case, your consulate will be in Canada but Foreign State Chargeability is to Mexico.

If you indicate on the petition the beneficiary's current legal residence that is where the interview will usually take place. That does not need to be their country of nationality.

There is a spot on there that you can put where the interview will take place....also there is a note in that section that if it is at a different place than your last residence you aren't guaranteed to get an interview it's based on workload at the consulate.

I mentioned it earlier, but you don't even have to legally be in a country to have your interview there.....nowhere does it say legal residence....just residence. I tried finding it here, but I've read in the past where people have had their interviews in countries in which they weren't even legal residents or legally in country.

I did not fill this question in as it only applies to those that are applying for adjustment of status. My husband is not in the US so will not be applying for adjustment.
