2 year marriage requirement

Hello all,

Today I passed the interview for CR1 visa and I was told the visa will be approved and sent in few days. Our 2 years marriage anniversary will be on December 20. I was planning to go to the United States after December 21st in order to qualify for 10 years greencard and avoid payment of the fees for removal of conditions in 2 years. In the counsulate however I was told by a lady (not consul) that the visa will enable me only to be a conditional resident. I was afraid to ask consul to confirm this. So the question is which date counts for 10 years greencard: 1. the date of the interview and visa issuance or 2. the date of entry to the United States. Did anybody traveled with CR1 visa shortly after the anniversary and received a permananent greed card?

Hi. As I understand it based on reading the forums you can "upgrade" your CR1 to IR1 at POE.

This was 2 yrs ago and I havent had the first hand experience to attest this. Feel free to correct me, if I am wrong.

" You are a CR if you were married for less than two

years to your U.S. citizen or permanent resident spouse

on the day your permanent resident status was granted."

I would like to hear someone's experience who has upgraded CR1 status to IR at the point of entry.

No it is when you get here (POE) not when you had an interview. The Visa in passport will be of course CR1. If you arrive in US on or after Dec. 21st, You remind the CBP and show marriage certificate, they update the computer and when you pay your Visa fee (before or after POE no matter) a 10 year green card will arrive.

Now the when did you have your medical. Because the 6 month arrival to US clock starts than you know. Didn't want you to run out of time (I'm sure you didn't have the medical 3 months ago. LOL) but weirder things have happened.

Thank you! The medical was done in August, so no issues with expiration until December, only January will be a problem. But I keep it in mind, thanks for pointing out. I stick to this plan anyways because we need to save money for living together. I will try to update what happens after POE.

Your residence starts when you hit your POE and they apply the stamp in the passport. IF you never travel you will never have been a resident of the US. Arrival is what completes the process.

POE after 2nd marriage anniversary date triggers IR-1 eligibility.

The day your permanent status is granted is at the POE.

The lady at the POE told me that because I was married just a year and 4 months I was going to be given a conditional resident status and she was insistent on the day when my husband has to remove the conditions.
