Hi everyone,

I have a question for a friend who is going on a similar journey as my husband and I. My husband and I went through the K1 route and have been married and in the US for over a year.

Our friends are looking into the CR1. Do they have to be married at the time of filing or can they be married before the interview?

July 25 - Biometrics Appointment Letter

July 28 - Walk in Biometrics successful

Aug 27 - Request for Expedite on EAD (Job Offer)

Sept 12 - EAD approved and in production

Sept 12 - AP is approved but USCIS status is in 'Post Decision Activity'

Sept 18 - EAD marked as mailed

2015

April 09 - Interview - Delayed due to sealed package from civil surgeon not at local office

May 07 - GC in production

May 18 - GC in hand!!!

2017

Feb 9 - ROC 

Feb 14 - Check Cashed

Feb 16 - NOA 1

Feb 25 - Received Biometrics Appointment

2018

April 10 - N400 Application

April 29 - Biometrics

January 29 - Combo Interview / Recommendation for Approval 

February 20 - Oath Ceremony - NATURALIZED

7th May 2013 - I-130 filed
4th June 2013 - NOA2 (approved)
16th July 2013 - Interview (approved)
30th July 2013 - POE San Francisco
29th August 2013 - 2 year green card arrived

* Removal of Conditions (RoC) via California Service Centre
1st May 2015 - 90 day RoC window opened
6th May 2015 - I-751 filed (delivered 8th May, cheque cashed 18th May)
7th August 2015 - Approved / GC production
27th August 2015 - 10 year green card arrived

* Naturalisation (Citizenship) via Phoenix Lockbox

* San Francisco Field Office:
1st May 2016 - N-400 window opened
20th August 2016 - N-400 filed
26th August 2016 - NOA1

Marriage certificate, not marriage licence (though in some states the marriage licence, once endorsed by the appropriate authority after the wedding, automatically becomes the marriage certificate).

If they're in Canada, there's no DCF option. DCF is only available in a small handful of countries.

It is easier to get married and then apply for a CR1 than going through the K1 process. It is faster and you will have the resident status (with direct work authorization) once you receive your visa.

Actually it depends on where they live in Canada.

K1 would be easier for west coast people. The cost of flying across Canada and the stay in Montreal may be more expensive than the trip to Vancouver. Make sure to include the cost of not just the AOS, but also lost wages for 3 months when calculating which would be the best route financially.
