Hi guys! Finally I'm here in America and married with the love of my life!

I'm going to apply for AOS, AP and EAD on Monday. I got all the paper works from the helpdul members here on VJ.

Questions...

1. The fee for the I-485 is $985 + $85 (biometrics), does it includes the fee for AP and EAD? Or I have to pay separately?

2. We're planning to pay for it via personal check, how does it work? What do we need to keep or to send along with the I-485 package as a proof of payment? Can we pay it in the morning then send the package in the afternoon? Or we need to wait a certain time before sending the package?

3. In the AP form, it asks there the date of travelling, I'm not really going anywhere as of now, my husband just want to apply for it for future use, like after a year we can go back to the Philippines, is it okay to apply now, but not really going to travel now?

4. I'm going to send the package via USPS in Chicago, IL, is it correct? In this address...

1. There is no fee for EAD and AP. $1070 is the fee for everything: AOS/EAD/AP

2. You include the personal check with your AOS application. The only way to pay is to include it in your package, the same way the I-129F petition was paid for. You can send the package whenever it is complete.

3. You do not need to indicate a date of traveling on the AP form. You can simply write UNKNOWN for date of travel and expected length of trip. Yes it is perfectly fine, in fact my wife also applied for the AP even though she never used it.

4. This is the correct address.

5. Yes, A-number stands for Alien Registration number. On your NOA2 it's the number after the A.

Thank you Zedayn! I'm currently completing all the requirements.

But, I have another question, I need 3 copies of our marriage certificate, is it okay if I just photocopy it, or I'm thinking of sending the certified copy of the marriage certificate in the AOS packet, and just photocopy it for the AP and EAD packets, would that fine?

Also, my birth certificate, do I have to send them an original copy or photocopy is okay?

I submitted the certified copy of the marriage certificate. For me I would rather send that, then make a copy myself and possibly get an rfe.. I hope that helps!

Interview Result : AP , requesting another PC (not expired) and certified divorce decree (was submitted)Stokes interview via phone for petitioner 4 hrs after interview.

Oct 23 email notification visa approved.
Visa Received : Nov. 3 , 2014 VISA IN HAND.

Marriage : Dec 27, 2014

AOS send : May 12, 2015, received May 14, 2015 USPS priority

July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

You only need to send in ONE certified copy of the marriage certificate, and that is for your AOS application. The EAD and AP applications do not require a marriage certificate.

The required documents for EAD and AP are:

EAD

  • Copy of bio page of passport
  • 2 passport size photos

AP

  • Copy of bio page of passport
  • Copy of K-1 visa
  • 2 passport size photos

You can submit a copy of your NSO birth certificate and it will be fine.

K-1

Guys, if i have a k1 visa, and now we're married, does it make me a k3 or spouse of us citizen? What is my new immigration status? Is it k3? I haven't done any update in uscis or anywhere else about my marriage. Just confused :(

No. You are a K-1 visa holder, that now happens to be the spouse of a USC. You entered with a K-1. A K-3 is a spousal visa, which is not what you obtained or entered with. See the example forms for filling out current status on the forms.

Your immigration status is the one you entered the US with. Since you entered on a K-1 visa, that is your status.

We just sent the AOS, EAD and AP package yesterday! Finally! ^^

Is it right that we just attached the payment check on the 1st page of the whole package? I'm really curious cos I don't have any idea. I also have erasures!!! Oh my! Is it okay? I'm so nervous right now.

I really want to work and help my husband, but all I have is a marriage certificate :(

Yes, check on top of package. Look into getting a SSN.
