Timeline

Question about a k1 petition. It was received in Texas February 20th 2015. They have not touched it yet. I plan to go to nigeria in October to see my fiance. When I get back, if I send a packet in with pictures and flight documents and such to show we spent time together with my case # will they add it to my file for when they do process it? Thanks!

I don't believe they will, especially if they haven't touched it, it'd be too much work to sort through it just to add to it.

Save the pictures for the actual interview. Pictures and such are supporting evidence, if you didn't send any supporting evidence with your petition back in Feburary than it's possible that you'll get an RFE and then you can send more, but I don't think it's possible to add more evidence to an already sent petition without getting an RFE.

Chances are your packet will not meet up with your petition and that it will be denied. You can then re file with all the evidence.

It is not a loss to try to send it in though. Make sure you send copies only.

Take pics with family and search for threads on front loading the next time around, extremely important for Lagos !

Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

OP and beneficiary have not met but send off petition. Denial is more realistic than RFE.

IF you send in supplemental evidence in the manner you describe, it MIGHT get hooked up with your other documents. It may be like finding two needles in a VERY LARGE haystack. People have likely had better success when submitting additional evidence with an RFE, at least there is a reference number to connect the two separate packets.

As has been discussed with you before, submitting evidence of more than one visit with the initial petition (front-loading) is an often used practice when dealing with notoriously hard embassies such as Lagos.

Wow...no we have not met yet hence the reason we are trying to work this all out. I'm sorry that I filed before figuring everything 100% out. I've been scrutinized and yelled at several times for making this mistake. People have been very rude about it. I'm just trying to work with what I have now and find a way to make it work without having to start all over again with fees and #######. I DON'T have the money for all of this. I realize you all feel the same way and Yes, I have to have money in order to bring him here. I've heard it all before. BUT, I'm a full time college student working multiple jobs and about to have surgery. I CAN'T afford all these fees nor can I afford airfare back and forth. I can't go to him right now because of the surgery and being unable to travel out of the country. He is a full time master's student as well and doesn't have a job (unemployment in Nigeria is way worse than in America). He has been doing side jobs, borrowing from his parents and looking into getting a loan to pay for all the fees and his airfare here but, can't afford several trips and/or paying for me to go back and forth.

This post and all my posts before this have been simple questions from those who have already done this. I appreciate feedback and help but, I don't appreciate the rude remarks and people treating me badly or as if I don't know anything. Yes, I've made mistakes but, that is why I'm here trying to learn and find ways to work with what I have. Thank you to those of you who have helped and are supportive about it.

Nobody is treating you badly. No one has yelled at you. You are being told the truth. You have not met. You will be denied. There is no way to "work with what you have'.

USCIS are not in the least concerned with whatever difficulties you think you have. Two hard and fast rules. You have to be free to marry. You have to have met.

You aren't going to get advice from people who have done this the way you are trying to. Those people have been denied.

In your first posts, you were advised to withdraw, meet and refile. That is what you need to do.

I can explain it to you. But I can't understand it for you.

I am sorry about the responses that aren't supportive like you pointed out and I understand how you feel. It's really difficult when you are pursuing an important goal and are presented with obstacles. The last time I saw my wife was two days after our wedding in Nigeria and it's been over a year now. I appreciate the many helpful answers I have received on this forum. They have made this journey a bit easier for me. I believe things will work out for you with prayers and the support you get from here. Don't give up. Remember, where there's a will, there's a way!

Last time you were here, in June, you were going to withdraw the petition. Everyone told you already you will be denied for not having met. Don't be surprised if they tell you the same thing again.

I don't think the question poses itself - if you filed in February you will receive the denial before you return from your trip. Just file again with the evidence. You'll have a good case then.

Also, you must have met before! The petition is filed. I recently looked at a USCIS website where they explained denied petitions. Someone appealed and sent proof that they met after filing. Didn't work. Still declined.

I was going to link those appeals when I got home today to show many have tried to meet after filing but before being reviewed...evidence was sent in but petition denied, appeal denied. Have to have met before getting what we call NOA1. So regardless if the evidence catches up it won't matter. Can you link those here so that all can see? I'm on my phone and at work...not optimal for me right now.
