You have to understand the decision to whether you need a joint sponsor or not is the sole decision of the embassy not NVC. NVC is merely a document intake facility and make sure everything is collected and you filled everything out right. If they stated in a letter you need a joint sponsor I would surely line that up because that information will be going to the embassy.

If you don't meet the guidelines they will be asking so yes you need a joint sponsor.

My husband household size is 5. We need 35,512.00 thats what I864P says.

he does 4,000.00 monthly and 52,000.00 annual, we sent pay stubs and employment letter to NVC, form 1099 and 1040 form too.

But the thing is the consul will focus on what he makes a year 52,000.00 which is his Gross income or in the abjusted gross income which is 14,709.00?

please tell me so my husband can find a Joint Sponsor, My interview letter says nothing about affidavit or joint sponsors.

Is he self employed or a contractor? Why is his adjusted income so low?

It's up to you. You said NVC said you needed a Joint sponsor I would get one so you have no delay. Your embassy is not easy. Your husband I hope will be there at interview correct? Maybe he will be able to answer also the CO's questions.

The adjusted is what they are concerned with since that is what you are bringing home not $52K after taxes $14K isn't much for a family of 5 so I would say you need a Joint sponsor.

I know tax year is over but can anyone help me? What tax prep software is best for MFS when spouse has no SSN?please help!!

Most tax prep software you can buy will NOT handle MFS when spouse has no SSN. And, you cannot e-file if your spouse does not have an SSN.

IF you find tax prep software that will allow a MFS with a blank SSN, you will still need to print the return on paper, write NRA in the SSN line and mail it in.

You MIGHT be able to put a fake SSN in the software as you prepare it, then print out the return (if the software will let you), cross out the fake SSN and put NRA. I've never tried this. But do not try to e-file under any circumstances.

DWheels, there are many perfectly good reasons why an Adjusted Gross Income can be much lower than a Gross Income. I think Rachel is going to be OK as she is. It may be that her husband knows how to use the tax laws wisely.

I believe they are more interested in Gross Income to start with - especially since the Gross Income for this person is steady over the last three years.

If Rachel wants to prepare Joint Sponsor paperwork just in case, then I think that is a good backup. I'm also not as familiar with her embassy/consulate - I do know that some love to throw curveballs at the last minute.

Rachel, if you go through getting Joint Sponsorship paperwork together, make sure you get it locked down tightly - with all the proper tax transcripts, original signatures, etc.
