This advice is best given when a non complicated petitioner is asking if he should use an attorney to file a simple petition, this is not the case.

You are wrong to advice DIY to the OP. You do not understand this case, the OP barely does and needs an attorney. Period.

It's not all about a waiver, the matter is far too complex to sort through to even establish the eligibility for a waiver.

We get it yes, some people can file successful waivers without an attorney and that is irrelevant here. In THIS CASE an attorney is needed.

And I agree if they are this unsure about their case. I was making a general comment about people always saying to get a lawyer as if it impossible to do things on their own with the correct understanding.

Now all of a sudden the Consular is replying to emails we had sent last week, we got two responses so far today, for emails sent last week.

They are now disclosing information, they tell there was not mistakes on the DS-160, that the consular cannot prompt the applicant about the waiver process (this was the last thing they were asking her before they abruptly stopped the first interview), that the decision the consular has made is based on CBP findings, and that if there was something that the consular could do to address the CBP finding they would, but there is nothing and they have to follow the law.

I am now waiting to see what they say about the two different Sections for the inadmissibility that were quoted yesterday, one about "smuggling" to me in one email and another about "trafficking" in an email to my fiance. I asked why are they sending us different sections for the inadmissibility and which one is the correct one.

I'm amazed they are e-mailing you so much. Government offices tend to do the opposite: not respond at all. On the other hand, the embassy is following the government tradition of providing conflicting information to you!
