Should we apply for I-130 before or after entering US on VWP?

Hello all!

My fiancé is Swedish and I've lived with him abroad for 3 years. We've now decided to move to the US (Los Angeles) sometime in the next 3-4 months.

As both the K-1 and K-3 visa waiting times seem to be over 7 months, we've opted to go the route of utilizing the Visa Waiver Program (tourist visa) for him when we move to the US, and later apply for the I-485 Adjustment of Status to allow him to stay.

This is where we are confused - should we apply for the I-130 visa before or after entering the USA? We would like to shoot for the quickest processing time.

Will it look suspicious for him to enter on the VWP while having submitted an I-130 already?

What you are proposing to do is illegal (entry on VWP with intent to stay and adjust status). It is also against the TOS of this board to advise on illegal activities.

You cannot enter under the VWP and then adjust status, that's illegal. Either you apply for a K-1 visa and get married in the US once that's approved or you get married now and apply for the CR-1 visa, which takes about a year.

If your Swedish spouse don't mind not working during this process, you can start the K-1 or CR-1 visa, enter the US under the VWP, after 90 days he need to fly back to Sweden for awhile, then he can come back for another 90 days and then you can keep doing that till you have your visa.

The quickest legal processing time is the K1.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
