so i posted here before its been a month and half now since my visa expired and i havent filed the aos yet due to medical exam taking forever and trying to get a passport type photo of my husband as he doesnt have one and is never off work to be able to take one will it be ok even if i file it this late into my over stay ?

You can take a picture of your spouse and use online photo editor to size it, printout at local store target, Walgreen, cvs

Done with K1, AOS and ROC

The immigration law says that you have to send in your application within 2 months from the expiry date of your visa! .I suggest that you send your application ASAP, even though your medical exam isnt finished yet, What will happen is that they will send you RFE and ask you about it during the process of your application. Hope this helps!

The US Department of State has a photo tool to use to make your passport photos. We printed ours at home. We used it for my husband's citizenship application and for both of our passports. You'll find it on this page.

i was on VWP but we decided at last minute aka 2 days before it was up to get married so its all been deck tic
