Marrying a lawful permanent residence with out of status issue

Hi there,

I am a tourist visa holder. What if i decided not to go back to my home country on my allowed stay, then I meet someone who is a lawful permanent residence here and willing to marry me with good faith.

Questions:

1. Is a lawful permanent resident of US can file a petition on my behalf so I can be lawful immigrant as well when we get marry?

2. Do I need to go back home if I marry a permanent resident? Or I can stay here and apply for adjustment of status?

1) No. Since you are out of status then your only way to adjust is through being an immediate relative of a US citizen.

2) Your spouse could file an I-130 for you, but you wouldn't be able to file an I-485. You would need to depart the US and interview abroad for your immigrant visa, which may or may not be denied depending on how long you have been out of status for. If denied due to at least 180 days of overstay then you would need to file an I-601 seeking a waiver of your admissibility, and would need to show why it would be a hardship to your LPR spouse if you were not admitted to the US.

Yes, but you indicated they were an LPR. You would not be eligible to file an I-485 until they became a US citizen.
