Same sex marriage ( Marrying a US citizen on tourist visa )

Hi everyone,

I have questions regarding my case here now in the US.

1. What is the 30, 60 and 90 day rule in marrying while in tourist visa??

2. What if for example, My I - 94 will expire on May 30, 2015. And we just decided to get married on May 28, 2015. Is my allowable stay wriiten in my I - 94 will be lifted, while im processing my adjustment of status???

3. Where to submit the forms and payment when filling all the forms needed in my case??

There is always a lot of emotion around this subject, but it is spelled out very clearly in the field manual...go to this link, and search for the 30/60 day rule and read every word of it, and your confusion about how it is implemented should evaporate. Actually, you should read this entire section of the manual, since it makes inadmissibility questions very clear, although it takes A LOT of words sometimes, and you have to plow through it.

While its a rule, its not strictly enforced and more of a guideline. In the end it's up to the USCIS to prove you committed fraud not for you to prove you didn't.

If you read the i-485 and i-130 instructions it tells you exactly where to file the forms. When you get the NOA1 from the i-485 you enter a period of authorized stay (legal presence) in the USA. At that point you no longer have to worry about "over staying" which is forgiven for spouses of USCs anyhow.
