I was applying for jobs on craigslist and a company in Hawaii really wants to hire me. I intend to tell them that I won't be able to work until I get my employment authority after my arrival in the US on the 28th of March. But, they have expressed multiple times that they really wanted to hire me and have me start working as soon as possible.

I'm going to the US on a K1 Visa and I understand that I won't be legally allowed to work until I get my papers sorted out.

So I'm wondering,

- How soon after the wedding, given that I was to file papers the very next day, am I going to get my employment authority.

- What are workarounds that I can do to make my employment faster?

- Can they legally hire me as a freelancer while in the Philippines and and continue work from the US?

Craigslist is one of the biggest scam in the USA, proeed with caution

Workaround to make employment faster? Legally there is none.

You are not allowed to work in USA until you have either a GC or EAD.

As said before BEWARE of craigslist posting about jobs. If they ask for any pre employment fees run away, They will get your fees and you will have nothing. It will take about 3-4 months under normal processing to be authorized. There is a small chance of an expedite if you have a job offer in hand.

This will not be over quickly. You will not enjoy this.

I am onboard with VOL. Craigslist can be problematic and so I to wish that you will proceed with caution. Don't send any money for this job offer. That will be the first sign that it's bogus. If you were traveling through Hawaii on your way to mainland USA and you had time and wanted to stop and visit with this employer then it sounds reasonable. But first, try and arrange phone call or better yet, a Skype call with video would be even better. Do your homework on this company by searching all the search engines as some can show you what others may not.

There is no expedite way of getting your EAD, if there was there would be plenty who would be standing in that line. As you know, everyone can find work in US and it's not like Philippines where only a few can find work.

Be very very careful of craiglist...unless you have very specialized skills

it's very skeptical that they are already trying to hire you knowing you are

in overseas.

I would check out their web site, call the numbers on the web site (imposing as someone else),

and do serious probing...including google-ing the company name.

Right now, I am leaning towards that job offer being more likely a scam than not...

So don't give any of your sensitive personal information until you fully checked them out.

Besides, you can't work until you get green card or work permit, which could take

more than several months after you file.

I have very specialized skills in Internet marketing and Hawaii seems to have a shortage of people with my skills/experience. I completely understand the possibility of getting scammed and understand which ones are scams and which ones aren't. We are communicating via email using their company's email address which I checked is real as well and no, we have not discussed anything about paying for fees to get myself employed.

Thanks everyone for your concern with regards to the above. :)

But what I really wanted to know is about how soon or how possible it might be to be able to work for this company. Which brings me back to my third question "- Can they legally hire me as a freelancer while in the Philippines and and continue work from the US?"

I am applying because I wanted to know how marketable my skills are in the US, apparently it seems like my skills are very marketable in Hawaii.


If it's really not possible to get hired sooner rather than later, perhaps I'm just going to enjoy myself some Hawaiian beaches and maybe even teach myself how to surf!

It will take you about 3 months after filing for the EAD to get your work authorization.

No they cannot legally hire you until you are authorized to work in the US. Not even as a freelancer.

If I were you this is what I would do:

(assuming that this company is genuine)

Explain about your immigration situation to the company and suggest the following:

They hire you immediately as a freelancer and you work remotely from your home country. (it sounded like that would be possible for you)

Let them know that once you arrive in the US you will not be able to work for them for 3-4 months at least because of your immigration situation.

Arrive - have a great time getting to know your new home (and networking and making great job contacts etc)

They rehire you once you have your EAD.

The worst case scenario if they agree to this is that they find someone else in the period of time you can't work and then don't want to rehire you - but even if this happens you will have over a month's worth of work experience with an American company for your resume and potentially a good reference.


It will take you about 3 months after filing for the EAD to get your work authorization.

No they cannot legally hire you until you are authorized to work in the US. Not even as a freelancer.

They can't hire you as a freelancer once you are IN the USA.

But there's nothing to say you can't do some work for them now remotely to get some experience and make contacts and get a reference BEFORE you arrive in the country.

We sent our EAD on November 21, 2014 and today got told that the EAD is approved and being sent in the mail (meaning I will receive it sometime next week).

It takes about 90 days from applying to receiving the card.

You can't work for them once you arrive in the USA, online or not.

You can also apply to expedite your EAD if you have a job offer letter and can demonstrate that you and your fiancé would experience extreme financial hardship (if your fiancé earns little income, send photocopies of most recent pay stubs).

If your expedite is successful, it could take around 60 days to receive your EAD.

As soon as your have a certified copy of your marriage certificate you can apply for AOS (and your EAD card), the EAD card tends to take 2-4 months (my wife got hers in 2 months)... and that is about as quick as you can start working. Until then you just have to be patient, there are no work-arounds.
