I cant breathe right now!!

My fiancé had his interview on 14/1/15, the officer at the embassy told him everything was fine and wanted to approve him, however due to the no live trace on his police certificate they needed to do additional checks. He had ordered a SAR prior to the interview but still has not received it. He presented them with a copy of an older police certificate that indicated what was on his record. The officer stated that if everything matched then he would be approved. The CEAC website had been under administrative processing until today. It now states 'Refused' . The message indicates to refer back to the letter given at the interview as to why it was refused. The letter given at the interview says 'needs newer APCO' that's it!!!

I don't know where to go from here. Does this mean we have to start over? Will he always get denied? Any ideas?

If this happened at the embassy stage, you should only need to submit the needed doc to the embassy then await their instructions. No need to start all over. And no, he will not always get denied. Assuming the new doc is OK, the embassy should approve. It might take up to 60 days for embassy to process the document, so it adds to the timeline, but it should not cause denial. He might have to interview again, I am not sure. The embassy will let you know once they processed the new document.

However, sounds like there's been a bit of a mix up with the paperwork being expired. It might be something as simple as submitting a new police certificate, if it says "no live trace" then he will need the right paperwork to submit explaining what is on his police record. If he updates his information and sends it to the embassy then they should approve it.

Hi there I'm theatregirl24 other half just to add I phoned the ACPO and they told me I should have my SAR by the end of the week. So when I get it I can still send it to the embassy even though it says I've been refused??

The "refused" part confuses me. I have never heard of anybody with that status report it here in the forum. If they were just waiting on documents, it would remain in Administrative Processing. Refused sounds as final as the opposite "Issued". Use the contact form to ask questions of the Immigrant Visa Unit.

Hi

I like to mention that they never actually asked me for any more documents the CO just told me that they will check it out themselves by the end of the day. I had read that this could happen so I ordered my SAR on the 26/12/14 just in case. But the CO had said from what she sees here that I'm approved just waiting on the checks and I have not been arrested in the last 12 years so my police certificate is as she saw it.

I just don't understand what else might of gone wrong?? So when I get my SAR can I just send it into the embassy?

I wouldn't wait and hope the SAR works. I would contact them TODAY and ask the meaning of the word "refused".

It could mean anything from they updated the wrong person, made a mistake, to discovered you had a crime involving moral turpitude which they couldn't approve. You can also mention you have a Subject Access Report en route you were planning to submit to clear up your police report issue.

I usually tell people to relax because they are getting worked up over nothing. In this case, I would be in panic mode. Get some answers from the only people who know...the IV unit.

Thank you for replying nick I've contacted the embassy through that link you sent. Not got back to me probably won't until tomorrow now.

I have no conviction that would be thought of as moral turpitude plus the CO saw what my record was and said that's fine but she just needed to check that was all there was. My partner just spoke with NVC and they said that the embassy has my file and they can't do nothing. I'm freaking out I've been with this Amy for three years now and I just want to start waking up next her.

Glad you contacted them. It could be as easy as they hit the wrong key to trigger the latest update. Cruel joke if that's the case. Maybe a new guy thinks you put that until everything is settled, but I have never seen that. Hope you get a good explanation ASAP.

Thank you so much for you help! I am in panic mode!! I rung the NVC & the woman had her head stuck up her bum & refused to look anything up. She just told me to ring the embassy.

I rung back & talked to someone else who said that my fiancé just needs to wait for a letter from the embassy detailing further instructions. I asked if the "refused" meant it was over. He said it wasn't that my fiancé just needed to complete one more step. He also said that if my fiancé didn't want to wait for the letter to have him ring the embassy himself.

February 24th 2015: Visa in hand!

February 26th 2015: POE at Las Vegas airport, then onwards to Oregon! 

March 6th 2015: Marriage (with a "real" wedding to follow next year on 7/6/2016)

March 9th 2015: AOS, EAD & AP submitted

September 22nd 2015: Interview

January 14th 2016: Two year Green card received -phew!

ROC

August 8th 2017: 90 day window begins! ROC time!

September 28th 2017: Biometric Appointment in Portland, OR

March 5th 2018: Case received by local office

August 18th 2018: 18 month extension letter mailed

December 2018: Case moved to another office

February 2019: I was emailed that I was approved and my card was in production the same day of my N400 interview 😂

I've never heard of "Refused" either, it's usually "Denied".

If it really is denied, then your case would go back to USCIS via NVC and from there it just kind of expires... theoretically the petitioner should receive a Notice of Intent to Revoke (they want to revoke your NOA2 and deny the petition, but give you a chance to submit further evidence before doing so), but K-1/I-129F petitions sent back to them expire before they even get round to reviewing them most of the time. And that would mean you would need to start from scratch.

So yes, the embassy will hopefully email you back tomorrow with some solid instructions, and hopefully it's just a case of submitting the SAR. I really hope they don't send your case back to USCIS.

ROC from CR-1 visa (Green Card expiration date was Nov 24th 2016)

 

Link to the evidence I submitted. Be sure to send evidence spanning your entire marriage (especially for K-1) or as far back as you can. Just one or two bank statements will not cut it. I primarily focused on the two years of living here since I came in on a CR-1. If you don't have the fundamentals (i.e. joint accounts/policies), you can explain why in the covering letter. E.g. "While we do not have joint utilities, we both contribute to them from our joint bank account".

 

September 26th 2016: I-751 package sent to CSC

September 28th 2016: Package delivered
September 30th 2016: Check cashed
October 3rd 2016: NOA1 received with receipt date of 09/28/16
November 3rd 2016: Biometrics received with appointment date of 11/14/16.
November 14th 2016: Attended biometrics appointment
October 30th 2017: Infopass appointment to get I-551 stamp
February 26th 2018: I-751 case number (aka the NOA1 receipt number) becomes trackable
March 14th 2018: Submitted service request due to being outside of processing time.

March 15th 2018: ROC approved. 535 days (1 year, 5 months and 17 days)

March 29th 2018: Card being produced

April 4th 2018: Card mailed out

April 6th 2018: Card in hand. Has incorrect "resident since" date. Submitted service request on I-751 case (typographical error on permanent resident card) and an I-90 online.

April 2018 - August 7th 2018: Tons of service requests, emails and now senator involvement to get my corrected green card back because what the heck, USCIS. Also some time in May I sent a letter to Potomac telling them I want to withdraw my I-90 since CSC were handling it.

August 8th 2018: Card in production thanks to the direct involvement of Senator Sherrod Brown's team

August 13th 2018: Card mailed

August 15th 2018: Card in hand with correct date. :joy:

October 31st 2018: Potomac sends out a notice stating they have closed out my I-90 per my request. Yay for no duplicate card drama.
