Hi guys, newbie here. A friend told me about this awesome website ive should've done it before so i dont need to hire atty from AOS to ROC and now im a USC. Oh well.. :-)

I will be in the process of petitioning my mother but on my birth certificate it says they are not married. I was surprised to see that because it's a public knowledge that they are and i haveall the docs to prove it (i was born 1978 and they got married 1975) Anyway, mom is of course using her married name until now even if dad is out of our lives (they are not annuled, more so divorce, there's no divorce in the Phils) And of course, when i start the petition, she will put that she is married because she is.

then, when i asked the Local civil registrar in P.I.,they said i need a lawyer to correct it.

Really? Lawyeragain? Will that "NOT MARRIED" thing on my birth cert affect my petition for mom?

Please help me. It's making me stressed. my understanding is that i have to prove the USCIS that we are mother-daughter.. or should all the information on my birth cert match with hers including her marriage cert?

You can still file for your mom because all that's needed to prove mother-daughter relationship is her name reflected as "mother" on your BC.

Ofcourse she would need to submit her NSO MC to NVC later on. Her marital status will not affect the petition in a negative way so don't worry.

I don't see how married or not married would affect your petition, after all she is your mom either way.

Did your mom get a CENOMAR from NSO? That may be a good place to start.

Your BC is the most and the best proof of relationship as mother and daughter,you are the one who will petition your mother,i dont think there will be an issue about the marriage cert of your parents..and you said you have all the document to prove that they are married..if they have marriage cert from NSO then you are good to go.. Hank, Nope, no cenomar, we'renot even attempting to do that because she is married. In fact i have now their marriage cert from NSO on Security Paper she said it might be the person who typed it on my BC that screwed up.

Whew! Whatta relief. We've gone through a lot since the AOS. Lawyer here lawyer there because we dont have any knowledge about immig. Btw i am a USC wife and a USC now.

That is where I was heading, if you request a CENOMAR from NSO and a person is married they issue a CEMAR - certificate of marriage.

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
