so i entered as k1, married my fiance before visa expires, now trying to apply for aos, aed, and ap

questions:

do i need to put my married name on all forms?

do i need to put our wedding photos?

do i need to put proof of same residence?

what do waivers do?

do i put 2x2 photos for each? one for aos, one for aed and one for ap?

what things do i need to prepare

where do i send in my application? i live in florida

No cover letter is required. Just put "Original I-485" on the outside of the mailing-envelope.

Use married name on all forms

You do not need wedding photos

You do not need proof of same residence

Waiver for what?

You will need 2 passport style photos (2 x 2) for EACH application. If you are applying for AOS, EAD and AP, you will need a total of 6 photos.

A note about the I-485 application. You only need to include the required documents. You do not need to include extra things such as proof of valid marriage, relationship, etc. Your marriage certificate is all the proof they need of that at this point. So save the photos and other evidences you may have for if you have an interview.

If you are going to have your photos, I strongly advise you to get it at Costco as it is the cheapest. I went to CVS and I almost fainted with the price. I don't want you to experience my mistake.

The fees for the I-765(EAD-work authorization) and I-131(AP-advance parole for travel) are waived when filed with a pending I-485, so include both of those too. It takes about 60-90 days to receive the EAD/AP combo card, which will allow you to work(along with an SSN) and re-enter the US when traveling abroad while waiting for the green card approval.

You need all the supporting documents for each form as well, so read the instructions for each one. You can also search here on VJ for what to include with each form if you get stumped. There are also example forms here on VJ you can look at when filling out the forms. They can be helpful.

Is it necessary? No. But what happens if you have a family emergency and need to return home?

The I-131 application is literally 7 pieces of paper plus the 2 passport photos, plus its FREE if you file with your AOS forms:

• Form I-131 (5 pages)
• Copy of biopage in your passport (1 page)
• Copy of K-1 visa (1 page)

It's better to have the AP and not need it, than for an emergency to happen and need AP and not have it.

Your husband does not need to fill out a G-325A. You are the one applying to adjust status, so you are the only one who needs to fill out the G-325A.

If you read the AP application, it's going to sound like you need to have some serious reasons

and specific travel plans (which we didn't), so we almost gave up on while filing along with EAD and GC,

but several VJers confirmed that you do not need any specific reason or plan to file AP, so I did.

I think it's worth getting it now...because should you need to travel urgently,

you can't get it quickly.

Because people tend to read about what has to be answered for DACA applicants, and what is required of those asking for humanitarian travel approval. Advance Parole for adjustment applicants is routinely approved, as long as you file the form correctly. No reason or explanation is needed for why you want or need AP. It states this in the form instructions. It also states at the bottom of page 2 of the form to skip from there to part 7, which skips the part of the form asking for a reason.
