Hi everyone! My fiancée and I are starting the process for the K1 Visa. She is currently here with my in NC (She is from Spain.) I just have a couple questions as I am new to all this.

First, I have researched extensively all the information on this website, which is incredibly useful! However, it is always better to have everything as clear as possible.

First, I have also been watching YouTube videos of petitions sent to the USCIS that have been accepted. Some of these were in binders, which I heard was a no-no haha. I think we will just have everything separated with sticked notes, but in a very organized manner, and put in a nice folder at the end...as the USCIS will disassemble everything anyway. Is this the best idea?

Second, for the affidavit of support, I have seen some petitioners send it with the I-129F petition, and some have not. Should I send it with, or wait until later in the process?

Continuing with this question...I unfortunately do not meet the requirements for being a sponsor, as my income at the moment does not meet the requirements. This will change soon, but at the moment it is not sufficient. Therefore, my mother will be the sponsor for my fiancée. Is this acceptable? If so, do my mother and I BOTH need to fill about the affidavit of support form?

I'm sure I have many more questions, but I don't want to overwhelm anyone or myself haha.

Sorry for the double post, but I just read that the I-134 isn't necessary until my fiancée's interview in Madrid...However, I've heard that because the K1 Visa is a non-immigrant visa, that joint sponsors (in my case, my mother, who has met and absolutely adores my fiancée) are not always accepted, and the entire petition could be denied because my mother would not be LEGALLY bound...This is very confusing :(.

Welcome to VJ! You will find very helpful information here. First, if you haven't already, please check out the K-1 guide here: http://www.visajourney.com/content/k1guide

Also, check out the example forms. It will help give you an idea of how to fill the forms out. I know it has helped me when I started. Here is the link for the example forms: http://www.visajourney.com/content/examples

Now to answer your specific questions.

1. USCIS will accept your petition if you use binders. It is not considered a no-no. However, it is a waste of time and money on your part to use a binder, since they go in the trash. What causes a petition to be rejected is if it either does not have the proper fee included, or it is missing a majority of the paperwork. All you need to do is organize your paperwork according to your cover letter, use paperclips to keep sections together, and then just slide them into a large mailer envelope.

2. The affidavit of support is not included with the I-129F petition. Your fiancee will need the I-134 Affidavit of Support when she has her actual visa interview. To give you an idea of the timeline, you first need to petition your fiancee with the I-129F. Then once that is approved, your fiancee will be allowed to apply for her actual K-1 visa at the embassy. You are looking at probably 6 months to a year before your fiancee will have her interview, and before you will actually need the affidavit of support. It's hard to give exact or even approximate times for how long it will actually take as it does vary a lot. As far as whether or not the embassy in Spain will accept co-sponsors, I would defer you to someone who is more knowledgeable on that. If you think your income will be sufficient by the time your fiancee will have her interview, you may not even need a co-sponsor. If you have a co-sponsor, your co-sponsor would also fill out the affidavit of support form and include all relevant evidence.

Again can you explain and direct me to the right place to read more about this. Also I have heard some people do in fact put their financial documents wit the I-129. As well as send it to their fiancee. Does this matter

Further question about co-sponser being accepted in Madrid: The US Embassy there will not answer questions on the phone about visas, and I cannot find an email address or any way to contact them to see if they accept them. I will post another thread being more specific.

Hi all, I realize I just posted another thread with a similar question, but I wanted to be more specific. Pardon me "freaking out."

Unfortunately, I do not meet the income requirements as the primary sponsor, so I will need a co-sponser, which would be my mother. I have tried to get in contact with the US Embassy in Madrid but they seem to not answer questions about visas. Does anyone know or has had experience with a fiancé(e) interview in Madrid with a co-sponsor? I realize that some embassies to not allow co-sponsors for K1 Visas.

You do not send the financial documents with the I-129F petition. They are required for the actual K-1 visa interview. If you sent them with the I-129F petition, then they will just be ignored, as the people adjudicating the petitions have nothing to do with checking over your finances and dealing with affidavits of support. You will simply provide the I-134 again for the K-1 interview and use updated supporting documents. I believe Spain does accept co-sponsors. You can email the IV unit to ask them if you can use a co-sponsor for the K-1 visa > ivmadrid@state.gov

Thank you for the information KayDeeCee! I have read some places that it seems that Spain accepts co-sponsors. I emailed that address that you gave me, but it gave me automatic response with websites and phone numbers :(.
