Once my fiancé gets here on K1, how soon can we adjust status? I was looking to get married with the first few weeks and send right away. Is there anything we need to wait for?

Marriage certificate, unless you got yours immediately.

You can marry as soon as you have the marriage license. Some States require a waiting period.

Here is your City website, it does not look like there is a waiting period but you should call and ask to be sure.

My Fiance had to produce his Passport as Identification. Best wishes and blessings for a wonderful marriage and life together!

We were married withing 5 days after arrival and sent his AOS within the first week as I had prepared everything I could in advance, so all we needed was the Marriage Certificate (Certified version) and the $1070. We asked for 4 certified copies at the same time we were getting married there.

We then remade his resume to US standards and as soon as he got a job offer were already scheduled for his Biometrics appt. and so we were able to request an Expedite of his EAD in that same week as well. He is now working and earning a living and it was the BEST decision we made to get him on his feet quickly so he feel strong and confident as an equal provider, etc.

We will have our actual Ceremony next Spring and we are just moving along wonderfully! Feeling very blessed and WAY less stressed!!! Now we can plan pour wedding and reception with clear heads and saved wages!! :dancing::thumbs::dance::yes:

NOTE: Actual sent date unknown due to lawyer negligence - I delivered ALLForms and PAID Lawyer on Nov 7, 2012 - Lawyer kept saying he sent the packet and USCIS must have lost it. When in reality he failed to send the package and only a new copy to USCIS after I made a legal written demand giving him 10 days to perform or return ALL monies paid to him, due to "non-performance".

(IMO it's better to save your money for visits to or from your Fiancé and just fill it out yourself using the K-1 Guide on VJ and Senior Members... They Rock!!!)

Thanks! We'll be getting married in Niagara Falls. I don't think there's a waiting period there either but their site is really vague. I'll have to call and ask!

EDIT- Oh wait..we'd be getting the license in Rochester. That makes more sense. Awesome- thanks for info! :) Also I hope our timeline for finding him a job goes as fast for us as it did for you! We will have our "real" ceremony in the spring too! Congrats!

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Can I ask why did you get 4? Just curious. I was thinking of getting 2 just to have. They're only $10, I guess I could handle a few more! lol

1 to send with AOS (because I read a few couples that they sent an RFE asking for original certified not a copy)

1 for Drivers License and getting SS#/card - same reason above some say copy is fine some ask for cert.

1 for backup and one for safe keeping-long-term-backup. lol (Umm I love to be OVER-Prepared when given the opportunity)

And awesomely enough they lady only charged me for NONE... :-D I mentioned when I asked for 4 copies... She looked stunned too so I pretty much said what I said above and mentioned immigration and wanting to avoid issues.. and voila!! 4 free certified copies!! :-D

Also be sure in your state.. here the marriage license is ONLY For the State is was issued in.

It is really very to be always overprepared. I think it helps so much in your life. I am trying to be the same :-)

I am coming to US soon with K-1 visa. I have some questions. May be you can help me. I am a little confused.

So after getting married we will apply for AOS. Should we apply for Driver license and SS# separately? What forms and what papers we have to fill out for it?

Hi Green color,

You might want to start your own thread so more people can see and answer! But from what I know:

You can apply for SSN at your local city office. People generally say to wait about 10 days to show up in the system. A driver's license is a bit trickier, because it varies state to state. Most states require that you have EAD or Green Card before you can get one.

But yes, they are 2 separate things and can't be applied for together. SSN is first.

Hey fellow Rochesterian!

Go to city hall downtown and apply for a marriage license as soon as your fiance gets here. Have them bring their passport and birth certificate for ID. You'll need two forms of ID also - I used my birth certificate and driver's license. NYS requires a 24 hour waiting period to use your marriage license, they will tell you that when you apply. When you apply for the license, you can go upstairs right after (third floor, city clerk's office room 300A) and they'll schedule a ceremony for you. Often they can marry you the same week or the next day if you want.

OH! If you get married at city hall they will give you a certified copy of the marriage certificate immediately after the ceremony - you just have to make sure that you ask them to do that. We had no problem and were able to file AOS a few days after our marriage.

We got married at ROC city hall on 11.24 and it was a breeze. The atrium is really pretty too.
