It's important for all US citizens to remember that we have a Constitution written by our forefathers that clearly addresses all of the issues of our police forces. We do NOT need new laws. We do NOT new new regulations. We do not need to alter the Constitution, but embrace and protect it. Each and every citizen of the United States is protected from illegal search and seizure. There MUST be probable cause to search or arrest. Everyone needs to learn and stand up for the rights that they have right now. A simple Internet search will provide you hundreds of hits and links to refresh. Please don't let the politicians continue to chip away and make us all less free in the name of security and protection. That is precisely what happens in dozens of other countries where the people actually believed their government was doing what was best for the citizen.

What was the officers probable cause? Bystanding while being black? The guy wasn't even under arrest.

Nope, not at all. But it certainly happens. We all make assumptions and judgements on people we have track records with, but that shouldn't change police procedure.

don't mention his 'store front' was within the line of site. you'd be profiling then.

Janelle, Eric was well known in that neighborhood. Store owners had been calling about him and others causing problems for months. They properly approached and attempted to reason with him and then arrest him. Then, all hell broke lose and their actions killed him.

well there's that old school tea party i was talking about last night.

the problem is when people do in fact HAVE TO submit to illegal search and seizure because doing otherwise is just the same as admitting guilt, giving police cause to believe a person is hiding something and that, in turn, becomes the probable cause.

I don't know what you were talking about last night, but the embracing and holding fast to the constitution and making removing government control is a Libertarian ideology.

At first, my reaction was "How can they not indict him after seeing that video?"

But the more I thought about it, I don't know what other options they had. When a police officer tells you to put your hands behind your back, you do it, no questions asked. If you think you are being arrested illegally, you can argue that point later, but not while they are trying to handcuff you.

NYPD (and all other major city PD's) procedure calls for the cop to go hands on once the subject is informed that he is being arrested and refuses to comply with an order to put his hands behind his back or exhibits any kind of aggressive or offensive motion. By "Hands on", I mean he is taken to the ground as quickly as possible and lays flat on his stomach. The cop has a lot more control/leverage over a subject when he is laying flat on the ground versus on his feet. For this reason he was taken down to the ground, or at least they tried to, and the fact that he was huge left the cops no choice but to take him down by his neck. Good luck taking a guy his size down to the ground any other way. If it was only 1 cop instead of the whole group, he would have gotten shot.

If the cops used a taser, that probably would've worked, but very few cops have them. The big guys are less resistant to them sometimes.

It doesn't matter what he was being arrested for, he resisted and became combative. He didn't deserve to die, but he brought it on himself. If he turned around and surrendered to the cops, it would be over and he'd be alive today. Let me know if you disagree with this.
