Some questions about I-129F, G325A

I completely agree with Kaydeecee. The problem is that USCIS has dozens of forms and each has their own instructions, so it's easy to get confused as to their overall requirement. The thing is that there is no overall way of doing it, you have to follow what each form requires.

For example, the N400 instructions say that you cannot leave some spaces blank and require that you put N/A or NONE. The I-130 also requires that you write N/A or NONE. The I-129F and the I-864 on the other hand, say to leave things that are N/A or NONE blank.

The reason people receive RFE's is because they don't follow the instructions of each particular form. They may have left things blank on one form like the I-129F, which is ok, but then left things blank on the G325A, which isn't ok.

Therefore, the rule of thumb is, don't assume that USCIS has an umbrella requirement for filling out their forms. Follow the instructions for each form to the letter.

This does not constitute legal advice.

standing on thinking about the form G-325A

1. variant 1 or variant 2 is more correct? (N/A in each cells)

2. should I specify the date from which the person was unemployed or leave blank

twovariants-1.gif

Go with Variant 1, but add the dates of unemployment.

Of course you don't fill in those boxes if you aren't in the military. Just put N/A in the first box. You're making this harder than it needs to be.

I didn't serve in the army and don't have any connection with the military

Should I fill those boxes in part 3?

Q1a- Q1h no. I believe you do need to answer everything circled in red, someone mentioned on the RFE master list recently they got an RFE for not filling out the sections in Q2.

If I am wrong then I am sure someone else will point it out, but this is what we did.

1a - 1h you can leave blank since it does not apply.

You MUST answer 2a, 2b, and 2c. Leaving these questions blank will result in an RFE.

If you answer NO to all questions on 2a, 2b and 2c, you can leave question 3 blank.

Leave question 4 blank unless you require a waiver (this only applies if this is your 2nd K-1 petition in less than 2 years or your 3rd or more K-1 petition).

^^^

This is the correct answer right here.

No to putting N/A on anything, as was suggested above, because it was already pointed out in this thread, any answer that would be N/A or None is left blank on the I-129F.

The military address does not apply, so it is left blank. You must answer the other questions that do apply to you. Yes or No for #2a.-c. If you had a criminal history, then answer #3, if not, then leave it blank. No waiver needed, then #4 is blank too.
