No money saved = denial ? ?

I left the sections asking about savings and assets blank on my I-134. When I filled it out I had less than $100 in savings. We submitted the most recent tax return with W2, employer letters and 3 months of recent pay stubs. We were approved no problem.

Thing is, that my fiancé already sent me the I-134 with his original signature via Fedex and we don't have money for another $150 Fedex package. I'm starting to get worried about this, what if they deny me just because it states that he has only a few hundred in savings, I really thought it was a must to state how much he has in the bank and include a bank letter. :(

I'll address both what you asked and other key points others touched on, as well as my own 2¢:

  1. They do not care about your fiance's savings account unless he's living off it (e.g. he has a trust fund which is his main source of income).
  2. If he is self-employed then he will need to show evidence of income (e.g. tax returns, freelance contracts, bank records so they can see he makes enough to support the household, etc.)
  3. If he's living paycheck-to-paycheck that AOS is going to be a b!tch. I'm in that situation now since I'm catching up on bills due to my husband needing 3 teeth extracted, wedding costs, and falling behind because I had to pay for his flight to the US and the friend who promised to help pay for the ticket as a re-payment for me helping them prior never owned up. The AOS is $1070, so I would recommend that during the AOS, you as the beneficiary bring that payment with you, as well as anything extra you can scrape up for living expenses, as you'll need things when you move here. Shampoo, deodorant, toothbrush, body wash, makeup, clothes & shoes appropriate for the climate if it's any different.
  4. You won't be able to work for 3-6 months after you file AOS, along with your EAD and AP. He will be your sole source of financial support, that makes it even harder to get that AOS payment together!

I had $0.00 in savings and I was self-employed at the time. I showed payments from freelance contracts, and my contracts as well with the company's Tax ID #, contact information, etc so they could contact all my freelance clients. I'm a web programmer. I also sent in the last 3 years' tax return, and printouts of my monthly bank statements. No letters from the bank.

Thanks for the answer. I have saved up a good sum of money during the past years so living after we file for AOS won't be a problem. And then again, most people get EAD in 70 days (~2 months) so I'll be able to work after not. Plus we are not gonna have a big wedding, only a courthouse ceremony with the close family and a few friends.

My question is, should I tell my fiancée to send another I-134 with the bank savings not included or should I just leave everything as it is and go to interview with the one that states his few hundred dollar savings? I'm so confused.

From what other people have said it sounds like the I-134 you already have will be fine, try not to worry. (I'm sure another VJ member will correct me if Im wrong however)

November 1st 2014: I-129f submitted for K1 visa

February 24th 2015: Visa in hand!

February 26th 2015: POE at Las Vegas airport, then onwards to Oregon! 

March 6th 2015: Marriage (with a "real" wedding to follow next year on 7/6/2016)

March 9th 2015: AOS, EAD & AP submitted

September 22nd 2015: Interview

January 14th 2016: Two year Green card received -phew!

August 8th 2017: 90 day window begins! ROC time!

September 28th 2017: Biometric Appointment in Portland, OR

March 5th 2018: Case received by local office

August 18th 2018: 18 month extension letter mailed

December 2018: Case moved to another office

February 2019: I was emailed that I was approved and my card was in production the same day of my N400 interview 😂

N400

August 8th 2018: Window opens to submit naturalization application

August 13th 2018: N400 Application submitted online 

August 14th 2018: NOA1

September 6th 2018: Biometrics

February 6th 2019: Interview Date! APPROVED!

February 6th 2019: I was asked to return later the same day for my Oath Ceremony! :dance:

I'm pretty sure you'll be fine. I listed my savings with more, when I sent it in, but by the time the interview came around that changed. They more care about his income than his savings, unless his savings is his main source of income.

The I-134 that was already sent is fine. No need to send another.

Thing is, I'm kinda in the same situation as the OP. My fiancé earns $27,000/year which is above the 125% of the poverty guidelines, and that's great! But he has only a few hundred in bank and we stated this on the I-134 (Affindavit of Support) as well. We thought it was a must. :( Is it a bad thing that our I-134 says he has only a few hundred in bank?

Btw as supporting evidence for the I-134 we have the IRS Tax Return Transcript (2013), IRS Wage & Income Transcript (2013), last 12 paychecks, employer letter and bank statement. Is this enough?

Something else self employed sponsors need to remember is the embassy will only consider your income after expenses. If you made $27,000 gross for the year but have $10,000 in expenses also listed on your tax return transcript, then you have $17,000 left, and that is the figure they will take into account. It might not apply to anyone here reading this, but it is helpful info to know. It has tripped so many people up because the instructions can be vague and/or hard to understand on the forms.

ROC from CR-1 visa (Green Card expiration date was Nov 24th 2016)

 

Link to the evidence I submitted. Be sure to send evidence spanning your entire marriage (especially for K-1) or as far back as you can. Just one or two bank statements will not cut it. I primarily focused on the two years of living here since I came in on a CR-1. If you don't have the fundamentals (i.e. joint accounts/policies), you can explain why in the covering letter. E.g. "While we do not have joint utilities, we both contribute to them from our joint bank account".

 

September 26th 2016: I-751 package sent to CSC

September 28th 2016: Package delivered
September 30th 2016: Check cashed
October 3rd 2016: NOA1 received with receipt date of 09/28/16
November 3rd 2016: Biometrics received with appointment date of 11/14/16.
November 14th 2016: Attended biometrics appointment
October 30th 2017: Infopass appointment to get I-551 stamp
February 26th 2018: I-751 case number (aka the NOA1 receipt number) becomes trackable
March 14th 2018: Submitted service request due to being outside of processing time.

March 15th 2018: ROC approved. 535 days (1 year, 5 months and 17 days)

March 29th 2018: Card being produced

April 4th 2018: Card mailed out

April 6th 2018: Card in hand. Has incorrect "resident since" date. Submitted service request on I-751 case (typographical error on permanent resident card) and an I-90 online.

April 2018 - August 7th 2018: Tons of service requests, emails and now senator involvement to get my corrected green card back because what the heck, USCIS. Also some time in May I sent a letter to Potomac telling them I want to withdraw my I-90 since CSC were handling it.

August 8th 2018: Card in production thanks to the direct involvement of Senator Sherrod Brown's team

August 13th 2018: Card mailed

August 15th 2018: Card in hand with correct date. :joy:

October 31st 2018: Potomac sends out a notice stating they have closed out my I-90 per my request. Yay for no duplicate card drama.

My fiance is not self employed. He is working full time in a stable position :)

Hey everyone this is great Info! I do have a question, for my fiance's interview he will have the opportunity to pay for his adjustment of status at his interview? Is this money I need to send him or can he pay for it on his own( which he can afford ) so, my question is is it money the 1070 that should come from me or can he pay it upfront himself? I am going to get a packet of thinG's he needs to start filling out and mail it to him this weekend or next weekend then, after I've gotten all my tax returns and things together mail that to him also. My goal is to do it this month before december as the mail system gets crazy

Adjustment of status happens in the US after your fiancé comes here and you get married.
