One more question but again its for the NVC process.

So my wife is trying to get ITIN number for me, so that she can file tax this year which will list married and also my name (that is what i think the case is).

My USC wife lives in Boulder, CO. With my wife working schedule, she hardly have any time off other than weekends and on weekends these offices don't work. She has been chasing this lady whose name is Ms. Rojas (this is one lady who is can help getting ITIN for me in my our district). This Ms. Rojas is never available, my wife had left many voice message, emails and gave her home number, work number and personal number to call back.. But seems Ms. Rojas is not so serious about work or she is just being pain in butt. And without that ITIN i dont think my wife can file the tax this year as married.

Do any one know who can help us in getting ITIN number?? I think there are different office and officer for every district. Therefore please note my wife lives in Boulder, CO.

Filing a tax return with a non-resident alien spouse

If a person is not a US citizen, permanent resident or resident alien, they are considered a non-resident alien.

There are several reasons why someone is a non-resident alien.

Generally, a non-resident alien (NRA) cannot file a joint return. That would mean that if you are married to a NRA, you would need to file as married filing separately or HoH if you have a qualifying child and meet the HoH requirements.

Filing married filing separately requires providing the SSN/ITIN for your spouse. However, NRAs often do not have an ITIN/SSN. If they are not required to get an ITIN (meaning they are not required to file a US tax return), you can file without it and write “NRA” in the field for the ITIN/SSN.Note however, that you wont be able to e-file doing this.

If the NRA spouse has no US source income, the other spouse can also take an exemption for the NRA spouse on a married filing separately return. In order to do this, the NRA spouse needs to apply for an ITIN if they don’t have an SSN/ITIN.

Another option is to file married filing jointly. Since an NRA can not do that, both spouses need to sign a statement that they both choose to treat the NRA spouse as a resident alien for the entire year. This allows them to file jointly. The choice is valid for any following year unless suspended or revoked.

Treating the NRA spouse as resident alien means that they are required to report worldwide income. If they have foreign earned income, they might be able to use the foreign earned income exclusion on form 2555(if the meet either the bona fide residency or physical presence test) and/or use the foreign paid tax credit on form 1116.

Filing jointly will also require the NRA spouse treated as resident alien for tax purposes to have an SSN or ITIN.

Hi i had the same problem with this last year for my wife, call this number it's in texas they handle the Itin 1-800-908-9982 and go from there after you get an operator on the phone she will tell you how to proceed

NRA doesn't work anymore when foreign spouse is out of the USA. Sorry.

Want an ITIN? Paper File the tax return, along with the ITIN form (W-7) and understand the document/ID requirements for that form.

File all via paper, must be tax return plus ITIN form. all paper, filed to special ITIN intake address in Austin Texas, listed in the ITIN /W-7 directions.

the 2nd year, if no SSN, can e-file using ITIN.

so- study a calendar for tax filing - see if it matches your NVC doc intake calendar,

and if it does not,

bring a new I-864 on interview day, showing the newly filed tax return.

maybe you have the perception that you must chase and get an ITIN before filing a tax return? It doesn't work that way , for the majority of people. There is an option to get an ITIN for large banking transactions, but that doesn't apply to you.

Thanks guys thats so much of help. So my wife actually have to chase that Ms. Rojas coz she is the only one who is in our district .

She is also going to call the number for support as mentioned by you guys.

See out of her tiring and demanding job, she has to deal with all the paperwork alone without me being there to hug her when she is tired... Feels #######

but then rule is rule.. She took off today to deal with this ITIN issue.

I am sure our AOS wont be filed at NVC before March or April. So NVC will have correct document with my ITIN no noted etc... But then we are preparing all the paper for NVC in advance as we are in nebraska and its already longest time to process from NOA1 to NOA2

i think it's a waste of time, to chase Ms. Rojas,

as

the only way to get the ITIN is to file the tax return document, IRS Form 1040, along with the W-7.

I suggest you look at the instructions on the W-7 document, fully understand the document/ID requirements there, and prep your stuff (you, the foreign spouse) to be compliant with the W-7.

You two get one shot at this, make sure you meet the requirements for ID in the W-7 instructions.

I mean it - chasing Ms. Rojas will be a waste of time.

She is not much compter savvy.. But i gave her user id and pwd and have forwarded the email i get from forum on this topic.

I sent her quick email saying to hold on and me doing studies.

Its my job to fetch her info and its her job to get it done... ;) thats how our team RT or team donkey (thats our way of laughing at everything we had to deal) works

At present none. We are studying and it says as an Id we need passport. I am yet to received a new passport (which will change the passport no). So we have kept this ITIN in hold till dec 1st week (that's when i am scheduled to get new passport) but then we are researching all the things and understanding.

Your info was so great. My wife actually logged into yesterday night and read all the info fetched by you.

And post that we both decided to do more research and study while we wait for my passport.
