It wont be an issue. Your fiance is free to apply for a tourist visa. But since your fiancee already has the intent to migrate, it might be a very very slim chance of getting a tourist visa approved. If you dont mind spending extra on it, go right ahead. Hoping for the best!

Tourist visas are not free to apply. It's $160.

You are too literal. That means they are ALLOWED to apply. I didn't say there is no filing fee. Pfft....

Same as saying "please feel free to call me anytime"...

@nsh: I am not misinformed. I said it was a very slim chance to get approved. I didn't say it was impossible. If you know of 2 people who successfully did it, it doesn't mean everyone else will get approved. Set realistic expectations. You and the OP are from different countries and each consulate (specially in high fraud countries) decides differently.

I visited with B2 visa. No issues. Your fiancè needs to qualify based on his own merits. The CO would want to see him come back and not overstay.

Prove strong ties that he will come back after a visit such as stable job, assets, savings, dependant family member (if any), or school schedule (if any).

If one already holds a tourist visa, they may travel and be honest that

a petition is filed, however a messed CBP (putting it mildly) can refuse

the person entry , and some have.

If holder currently holds no visa , applying for one is a waste ,99% of

the time it will be denied, however its not considered fraud. But the

intent to back-door immigrate is in the fore-front of applying

Is there any posibility this will be approved and visa issued by January?

Any tips?

It's best to start your own topic to get responses. This thread is in regards to applying for a tourist visa. Your subject is completely different.

When immrsregi said "Your fiance is free to apply for a tourist visa", immrsregi was't referring to the cost. Immrsregi was just saying OP's fiance has nothing that would prevent him from applying visa.

Tourist visas are not free to apply. It's $160.
