Hello Everyone,

My husband and I filed the i 751 in march 2014. i had the biometrics appointment very early. after the 6 month of regular processing time have passed i called uscis to get information about our case. 2 times i did not receive a satifying answer, but i received a letter after the second call stating that we have received and RFE on 06/06/. Since we have not received the letter I called again. The lady said she couldnt see anything in the system and would send another email to the service center. in the mean time i made an infopass appointment at my local uscis office just to make sure I know everything that is going on. In the office they told me that they are not able to see an RFE and that they will send another email to the california service center. Last saturday I finally received the RFE. it stated that the proof we send that we have a bonafide marriage is not enough. They also said they want proof if certain things for the past 2 years. Here is where the problem starts. We did not have a joint bank account together and we did not file out taxes together. My husband still has to pay child support for his kids from his first kids and we simply didnt want that my money goes there too and make sure i can keep what i earn. we always split the bills. he paid gas, electirc etc and i paid the house and food. since we had our own system and everything went well we never saw the need to add me to any bills. i have life insurance on him and myself and he is the benefociary and he is on my medical insurance and i am on the car insurance, but thats it. Do you guys have any idea what I could provide as proof with our situation? we thought about adding me to all the bills and open up a joint bank account now, but that still doesnt show the past 2 year. I really could use some help or adive. We have 8 affidavits of friends and family, pictures, emails, text messages, we will add me to the title of the car. but thats it. I would appreciate any help!

Have you written your wills yet. If not that could be a way of providing more evidence. My Husband and I are short on docs, a bit like you, and we wrote wills, making each other beneficiary etc. Lodged later than you and have heard a peep yet, but writing wills might help?

Co mingling of finances ( bank statements, tax returns) are very strong evidence but since you don't have any, I can't think of anything else really. Getting a joint account now wouldn't make any sense since you have to submit statements over the course of 2 yrs.

I would suggest you write a letter, list everything they asked for and give reasonable explanation as to why they are not available. Resend what was already sent and dig up every little thing you can think of.( photos, mails with same address, W-2s showing you shared the same address) if the medical insurance and life insurance were deducted from your paycheck, send in copies of your paystub showing that you are paying for that bi-weekly or monthly.

Also don't be afraid to highlight everything you want them to focus on.

I would suggest you write a letter, list everything they asked for and give reasonable explanation as to why they are not available. Thank you for your answer. We wanted to add me to the title of the car. Would that make sense? Would it make sense that I print out my bank statements showing that I paid for the mortgage and his hospital bills? We have credit cards together for the HSA medical account. Would that make sense. I will get a letter from work for the medical and life insurance. Would I still need the paystubs? Do you think it would make sense to add either one of us to the others bank account now?

I wouldn't bother adding each other to accounts at this late in the game. Car title would be good, and if you can send the HSA account statements with both names highlighted that is strong evidence. A will is also good. I would do that and then do what Newbie said and write a letter with explanations. That's your best bet.

The HSA account statement is only in my name, but we both have credit cards for it. I never had the chance to open the HSA with him, since the medical insurance goes through my employer.

That's odd, our HSA has both names on the statement since we each have a card too even though the insurance is only through his employer. If that's the case, make a copy of both cards, and then send statements over the full period. They'll get the picture.

Even if you didn't file taxes together, you still filed "married filing separately" correct? (if you've been married, it's required to file as married) You can still send those. But yes, a letter addressing their concerns would be a good idea.

Whenever we get a letter from the HSA account it only shows my name in the letter head. Not sure why. Yes we did file "married filing seperately" and I send it in already the first time. I will send it in again.

Ok so I wil send him the At and T stuff. We never really went anywhere except with the car and we staid with friends! So no real things there. We went camping once, but I just paid it from my account.

Yes I will do that and I will highlight things as someone else suggested also. I will make sure they see everything I want them to see and I will also write the letter (explanation). All of our things have the same address on it, just not our names. Thanks again for all the response I have received here so far.

I would just take every suggestion here, and then post the list of evidence so we can all look at it and see before you mail it.

Someone else mentioned that although both names weren't on everything, they still mailed it in with the explanation of whom paid what, and to prove joint address.

Here is what I thought so far:

- letter from work to prove that he is on my medical insurance and that he has his own HSA credit card

- copy of both HSA credit cards and medical insurance cards

- letter from work stating that I have life insurance on him

- letter from work stating that he is the beneficiary for my life insurance

- letter from work stating that I have life insurance on his daughter

- then a statement why we didnt file the taxes together or have a joint bank account

- car title for one of our cars where i am on

- copy of both drivers licenses

- copy of greencard

- W2 and tax returns showing that we filed "married seperately"

- copies of my bank account and a copy of the house mortgage bill showing that I pay for it

- copy of At & T showing that my husband is able to manage things on the account without my permission and bank statement showing that I pay for it

- copy of his hospital bills and checks with my name printed out

- copies and statements from cable, electric, water and gas that we added me NOW to the account

- copies from car insurance and proof that I am allowed to drive the car

- copy from the doc showing that we are each others emergency contacts

- cards we have received from family for christmas for US together (2 from same person)

- 8 affidavits from friends

- picture pf christmas tree ornament with both of our names and the year 2013 (gift from his mother)

-emails and text that show daily communication like "whats for dinner"

- pics from us with his daughter and us together

- picture he drew for me on our wedding anniversary last year with his signature and date

- cards that his daughter made for me

thats all I have so far I would send
