I still think the OP should just email Islamabad directly and ask them. They either can go ahead and apply or just wait a year or two until she is a bit older.

I met my fiancé back in year 2012 and we get engaged soon after, she will be turning 18 on november2015. To answer the question about California law for minors to get married is to have a written consent from one of the parents or a legal guardian . The only thing is her age relevancy to her K1 eligibility, which I'm still not getting a clear answer. I'm sure there be a lot of VJs came across through same situation, hope that VJ heard me n solve this mystery.

BTW , I'm the petitioner and I'm legally eligible to file for her K1 petition, she is the beneficiary.

You already got the clearest answer you're going to from anyone here: you need to contact the embassy in Pakistan and ask them. That's the only way you can be 100% sure.

Have you seen your fiancee in person in the last two years? If not, then you can't file.

I'm not so sure there are a lot of VJers engaged to 16 yr olds that can respond to your inquiry. Best to contact the embassy as other posts have stated.

You have two issues to clear up...on your own..

One what is the minimum age to marry in the state you intend to get married in.

Two what is the minimum age that the Embassy will allow a K-1 to be issued to.
