My brother's green card expired, and father is US citizen living outside US. Can he sponsor my brother?

Yes irrespective of the type of emergency , NVC is not able to expedite the immigrant visa petition until the PD is current.

Thanks! Ok I get it. At least we dont fall in trap of the lawyer, telling us to get my brother here in 3 years instead of 10!

Because he told us that he can get case expedited in 3 years time if we give him a good medical reason!

If he says he can do that, make a contract with him, that only pays if he is able to do it. But as far as I know there are no F3's that were that came in under 7 or even 10 years.

It means, no matter what medical condition my father has, my brother in Pakistan shall have to wait for PD to become current in usual manner (like 8-10 years) and cannot come to US before that! Plz confirm me.

No medical reason is grounds for an expedite. Yo will have to wait it out. Unfortunately you will also have to consider one more thing: If your father won't be able to return to the US in about 10 years, your brother won't be able to go either. Might be wise for one of his siblings to file a petition under the F4 category. Will take longer than F3, but it would keep options open.

It's amazing how many questions can be resolved with a 2 minute Google search...
