USCIS now wants final court disposition .. but impossible to now get

Well, we just got back from the Court Clerks Office. Obviously they could not give me a copy of the courts final disposition of the case, but they did give me a certified (embossed stamped) letter stating:

"Based upon information provided, the requested document / record cannot be located. We cannot confirm or deny a case for: Case #12MM243--- / Name: Mary ----------) exist in our case management system".

Well, the request for further documentation my wife got from USCIS during her interview stated that the certified copy from the Clerks office of 'No Record' should confirm that the record is 'Unavailable'.

I just hope the wording the Clerk's office used is ok ..... This is the best I could do.

Anyway ... That certified document is now in the mail on it's way to the USCIS field office where my wife got her interview a couple of days ago. I also addressed the letter to the Attn: of the officer that interviewed her.

I guess we shall now see what happens.

What I learned from this is that I should have gone to the Court Clerk's office [prior] to the expungement date to get a couple of certified copies of the final court disposition for my wife's case ... but, I had no idea.

Just an update ... Just got an email from the Tampa field office.

My wife's case has gone to a supervisor for review.

Keeping my fingers crossed.

Update ... Things have worked out good.

Just got an email stating that my wife has been placed in line for her oath ceremony, so everything worked out as far as the supervisor's review of her case.

Could you launch a FOIA request for this? This could be faster than opening the case.

Well, my wife has now been finally approved for her citizenship since they put her in-line for her oath ceremony, so I guess this whole deal is now just a non-issue.

But Again .... For anyone out there that has had a run-in with the law and is seeking naturalization ... if your not convicted of any crime, and you are going to have your record expunged ... Make damned sure you get a certified copy of the court final disposition of your case [ [ BEFORE ] ] you have the record expunged !

USCIS want's to see that certified copy showing the case was dismissed by the court.

BTW ... Here is a photo of the letter I sent to USCIS along with my wife's N-400 that explained the problem.

However, you can see that we still had problems that arose during the interview.

Hi... i was also arrested before but " NOT CONVICTED "and my case was dismissed and sealed too.. my criminal defense got me a certified copy from the court clerk stating that my case was unavailable... coz my criminal defense asked a request to get a final disposition from the court clerk and they cant find my case number and did not exist anymore .. i will just file my citizenship this month and i wang everything ready... i just did what you did when your wife cant get any final disposition "( getting a certified copy from the court clerk stating that my case was unavailable ") i hope that works too and They wont ask me more requirements.. coz i dont want to spend money and travel to the other state and to waste time to unseal my case

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
