Hi Everyone,



My name is Ahmad i recently got married in Pakistan and i am green card holder. I want to start process and i am really confused. I have contacted lawyers and they asking too much to file the case. So can please anyone guide me the right way and documents required so i can file the by my own.

How long wiill it take for you to get your citizenship? most people recommened waiting to get your citizenship before petitioning a wife.

I-129F: Name Change request made 10/31/2014

I-129F: Crickets as of today

It will take three years to become citizen.

You should file I130 petition now. As under F2A category it will take maximum 2 years for your spouse to get an immigrant visa. And if you get lucky then it will take much shorter than two years.

These are the things we sent in our I130 package:

  1. Filing fee -420$
  2. Form G-1145(e-Notification of Application)
  3. Form I-130
  4. Evidence of my US permanent residential status (Green Card)
  5. Form G-325A completed and signed by the petitioner
  6. Two passport size photographs of the Petitioner
  7. Form G-325A completed and signed by the beneficiary
  8. Two passport size photographs of the beneficiary
  9. Copy of our marriage certificate. (Include both the copy of original one with the english translation)
  10. Two sworn affidavits from relatives about the bona fide marital relationship
  11. Copy of beneficiary passport (Though not needed we sent it along)
  12. Copy of beneficiary birth certificate (Though not needed we sent it along)
  13. Our wedding photographs (6 )
  14. Other photographs together over a period of time (6)
  15. Family photograph (2)
  16. Boarding pass from Air India for Trip to India to marry beneficiary
  17. Previous flight e-ticket receipt to India to meet beneficiary
  18. Some facebook messages between us
  19. Some excerpts of Gmail chat histories between us

Other information:

we also provided with our facebook id's.

You can send all of the above documents. The copy of beneficiary birth certificate and passport is not needed at the I130 petition stage. But we included that also.

Be sure to include two G-325 forms along with the petition. One should be filled up and signed by you. Other should be filled up and signed by your spouse.

The signatures should be original. No scanned or copied signature is allowed. Your wife should download acopy of G-325 form from here

http://www.uscis.gov/sites/default/files/files/form/g-325.pdf. Then she can fill it up on PC and then she has to take a print out of the form and then sign at proper place. Then she can mail it to you via courier or speed post.

I'm not sure who are the "most people" that are recommending that you have to be a USC before petitioning a spouse. That is highly unnecessary and untrue. An LPR has as much right as a USC to petition a spouse in spite of the wait.

The process to petition a spouse of an LPR is currently taking about 2 to 3 years and can be less if the PD's move up or become current.

If you do become a USC while the process is pending, you can have your petition upgraded and it will be processed much faster since there would not be a need for your PD to be current. Spouses of USC's always have visas available.
