Yes, you can submit the passport instead of a notarized copy.

I had my wife send me her passport when I applied for an ITIN for her. But then I got nervous about sending the passport to the IRS so I had a photocopy made and notarized and sent that instead.

Can you submit the passport instead of a notarized copy? My husband lives far from the Embassy so it would a lot easier to have him send it to me? And if so do I attach it to the 2006 tax return or can I apply for the ITIN in advance?

Oh I didn't I can have it notarized instead of him. That's even better. I will have him send it to me and I'll take care of it. I read the instructions but didn't see where I can apply for a ITIN before filing.

In this case the notary is not notarizing the signing of the document, the notary is certifying that the photocopy is an exact, unaltered, copy of the original document.

I cld the IRS # on the website and was on the phone w/the guy for an hour. He said the TAC will accept the form but will not process it. They will forward to the central office and will take 4-6 wks for processing. He did however, tell me I can file Head of Household (b/c I have a child) then file an amended return once my husband recv his SS#. He said it takes that long to process the W7 form and then another 4-7 to process my taxes. I'm thinking it will be to long for me to wait so I will probably file HOH and amend at a later time. But man, it would have looks great for the interview. I'm going to talk this over w/my hubby and make a decision but if it was up to me I would wait b/c we need those funds to help w/these immigration costs... :whistle:

Yes he said 4-6 wks for the W7 to be processed and once the ITIN is assigned it will then be forwarded to the correct dept to process the tax return which can take another 4-7 wks. The rep says worse case scenirio (sp?) 10-14 wks for everything.

So about 3 months for the total process. That's not so bad. In the 'old days' regular taxes took that long to turn around. :)

Plus as you said it will only help with evidence of relationship for the interview. :thumbs:

In our AOS interview, the only thing the interviewer looked at on the tax returns for last year was the amount of income and whether we had filed married and listed each other as spouse. I told her we had filed separately and she said that wasn't a problem as long as we filed married and not single. Just my personal experience! :thumbs:

08/02/05: Biometrics , New Orleans. Pretty uneventful.

Im confused here. If im currently living with my parents and my husband is in the UK how do I file. I cant file head of house hold because i live with my parents. Should I file for an ITIN for for my husband and file married jointly or married and file seprate? What is the better way to go? What happens in the event that the spouce has nothing to file?

Filing a joint return can have tax benefits if you have a significant amount of income. For immigrations purposes it doesn't really matter :)

I read the instructions on the W7 form, and it states this regarding the certified copies:

* Notarized by a U.S. notary public legally authorized within his or her local jurisdiction to certify that the document is a true copy of the original. To do this, the notary must see the valid, unaltered original document and verify that the copy conforms to the original. U.S. notaries public are available at U.S. embassies and consulates worldwide. Foreign notaries are acceptable as outlined by the Hague Convention.

I have a photocopy of my wife's passport. However, it was stamped and notarized by the Vietnamese Government not by a U.S. notary public. Is it ok for me to to submit that too since the words in that instructions seem to suggest that it is ok? Sorry for the dumb question, but English isn't my first language. :D

I don't see Vietnam under the Hague Convention so you might need some additional verification from the US Consulate. I am not 100% sure but if I am basing the notarized document solely on this list then it might not be recognized by the IRS.

My wife went to the US Embassy in Ho Chi Minh, Vietnam yesterday, and they won't notarize something for non-US citizen. I'll have to try to call them tonight.

We're in a different situation being that my wife is in the Philippines but I was told that the issuing agency (Dept of Foreign Affairs) would be the one to certify/notarize her passport. She went to the DFA and should receive her paperwork in about s weeks. I don't know if that applies to Vietnam as well or not.
