Hi,

I have some questions related to the form AOS Package.

I requested my wife and stepson (3 years old). I already paid the AOS fee.

I have the employment letter.

I have my last paystubs.

I asked my cousin for the paper that he needs to have in case I need a joint sponsor.

Form I-864

Part 1: Basis for filing Affidavit of Support.

1. My Name

1.a I have to mark this, because I'm the petitioner, right?

Part 2: Information on the principal immigrant.

I have to fill the info of my wife for her I-864 and the I-864 for my stepson, right?

Part 3: Information on the immigrant(s) you are sponsoring.

This is the part I get confuse.

How do I fill this? I got not clue on this part.

Part 4: Information on the Sponsor.

Ok, this part is about the sponsor. So, I have to state my full name, mailing address (What I do if the address is longer than the field?), place of residence, other info.

If I need a joint sponsor, he have to fill a separate I-864, right?

Part 5: Sponsor’s household size.

How do I fill this part? for my wife and stepson?

Part 6: Sponsor’s income and employment.

Help on this please.

Also, I earning only 19,000 this year. I have a cousin that could be my joint sponsor he fills his taxes with her wife.

I want to send this package this week.

September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

I have to fill the info of my wife for her I-864 and the I-864 for my stepson, right? Yes, one for each.

Part 3: Information on the immigrant(s) you are sponsoring.

This is the part I get confuse.

How do I fill this? I got not clue on this part. Check the "yes" box in no. 1, leave everything else blank, and enter "1" in no. 7.

Part 4: Information on the Sponsor.

Ok, this part is about the sponsor. So, I have to state my full name, mailing address (What I do if the address is longer than the field?), place of residence, other info. Yes. You can abbreviate common names like MLK, ST, DR, AVE, if not just hand write that part.

If I need a joint sponsor, he have to fill a separate I-864, right? Yes, one from each of you. 2 for your wife, 2 for the child. 4 in total.

Part 5: Sponsor’s household size.

How do I fill this part? for my wife and stepson? Enter "1" in no. 1, enter "1" in no. 4, enter "3" in no. 8 for your wife's I-864. Enter "1" in no 1, enter "1" in no 3, enter "3" in no. 8 for your stepson's I-864. Leave everything else blank unless you have other children or dependents, or other people you previously sponsored.

Part 6: Sponsor’s income and employment.

Help on this please.

Also, I earning only 19,000 this year. I have a cousin that could be my joint sponsor he fills his taxes with her wife.

I want to send this package this week. You fill out this part with your current annual income, meaning what you will earn by the end of the year, not what you made last year.

For a household size of 3, you have to make at least $24,737. So you will need a joint sponsor. If it's just your cousin and his wife, that's a household of 4, so the 2 of them plus your wife and stepson. So they would need to make $29,812.

If he makes this much by himself, his wife doesn't need an I-864A, but he has to prove his share of the income with his w2s, paystubs/letter of employment. If his wife is willing to use her income as well, then she would need to fill out an I-864A and send letter of employment/paystubs to prove her current income. I assume they file jointly, so they would need the tax transcripts or full tax returns.

Your cousin will also need to submit proof of LPR or USC status.

Also since it's 2 separate cases, the docs have to be separate as well. So two letters of employment from you, one for your wife, one for your stepson. Same thing for your joint sponsor and his wife. I'm not sure if you can use copies.

Are you sure!? If you are right, then I just extended my case to go on for longer...... Thanks for the info. I guess that I have been waiting for so long that what diference does it really make by this point ?.

SHOULD I WRITE A LETTER AND SEND IT WITH THE CORRECT INFORMATION, OR DO I JUST WAIT UNTIL THEY SEND THEM BACK TO ME?

So I don't have to include my stepson in the family members?

I live with my parent at the same address, Can I use my fathers salary instead of a joint sponsor? He receives Social Security and doesn't have to fill tax returns.

You don't include your stepson on your wife's part 3, and you don't include her in your stepson's part 3. They are both separate cases so you cannot list them here.

Yes, if your father lives with you, you are able to combine your income with his in order to meet the 125% level requirements. Keep in mind that he has to be included in your household size. So you, your wife, stepson, and your dad would be a household of 4, assuming you don't have any other dependents or persons you have previously sponsored. You have to make $29,812 or more for a household of 4. Your dad would fill out I-864A and he has to submit proof of current income (a letter from the SSA, which you can get online), a letter explaining why he isn't required to file taxes, and proof of your relationship (birth certificate) and proof that you live in the same residence. If you guys don't make the required amount, you would need a joint sponsor.

Is this correct?
If I do this, Do I have to put my mother in the household size or just him?
I'm earning $12,800 YTD but in the past year as I was starting in this job I only made $6,649 as stated in my W2. My father received $14,991 last year. I'll make like $18,700 this year. I'm good with that or I need a joint sponsor.

If your mother lives with you too, you can include her only if she has enough income. That would bring your household size up to 5, and for 5 people you have to make $34,887.

Based on what you're telling me, between you and your father your income would be $33,691, which puts you over the minimum required for a family of 4. Therefore, as long as you and your father are currently making that much, then he should submit an I-864A and you wouldn't need a joint sponsor.

Also the good thing about using your dad as a household member, is that you don't have to include your mother as part of the household size even if they're married. The reason for that is because the I-864A doesn't ask for the household size like the I-864 does.

You can fill this part out from the quote, how it says, plus your dad of course if you will be using his income. You can technically list your stepson on your wife's I-864 in part 5 no 4. Stepchildren are considered dependents for tax purposes. I have seen people fill it out either way, at the end of the day you will still have a household of 4, even if your wife's I-864 would say "3" if you don't list your stepson there.

You need a joint sponsor. If you live with your father you can combine incomes. I"m not sure about your mother. I think it would be odd not to include her. Does she work? Does she make more than your father? Can she not be your joint sponsor? I wish pushbrk was here because he really is the best at this.

Is there no one else who can be your joint sponsor? A friend or someone who makes more money?

Step children DO NOT go on the I-864 for a spouse because they have their OWN petition. I do not believe they are not considered dependents for tax purposes until they live with the step parent in the USA.
