dear family

i wont take much of your time, but as i said , you are my hope

* i am a man

* married to usa wife and together  filled  i 130, i 485, i 765, i 131  and got my medical exams , then got my combo card ( ead and ap)

* was abused by my wife

*i filled vawa and transferred  i 485, i 765, i 131 to be under my petition not my wife

* got vawa approved  and supplemental notice of deferred action  and derivative children notice for my 2 kids who live in my original country (egypt)

* i 485 still pending

 

question

 

now i live in usa and i go egypt and back by my advance parole combo card

how do i bring my kids to usa

can i do it with my pending i 485 or do i have to wait till i am approved?

You could sponsor them when/if you become a Legal Permanent Resident.

Considering the children are unmarried and under 21 years old the alien can file the I-824 concurrently with I-485 or anytime BEFORE the I-485 is approved,in your case file the I-824 now for you children, and they will have consular processing maximum 01 year after your approval, but if you wait for your I-485 approval then your kids will take years to come to the US (2/4 years).

Reminding everyone that posted here that he is a I-360 SELF PETITIONER with Vawa approved,it means his kids are BENEFICIARY of his petition. He doesn't need to submit I-360,he doesn't need to wait I-485 approval, the alien can submit I-824 concurrently with I-485 or before I-485 approval.

i need your help in writting the form 824 i have some questions

part 1

question 1 am i the applicant or the petitioner?

question 4 shall i write current immigration staus pending i 485?

part 2

reason for request ?? which answer?

i am vawa approved

my kids are 11 and 8

they are derivative children in the approval vawa notice

i got deffered action supplemental notice

my i 485 is still pending

so what answer i pick ?

i read you telling one of the people you were helping not o write his name on the form 824 or else the uscis will send his papers to the consulate not his children ???????????????

i am sorry i take much of your time but i am in need for your help and god will reward you for helping all of us

what documents do i have to attach to the form 824

what are the fees?

where to send this 824 form after i fill it ? vermont ? nebraska?

finally dear sandrnj

am i confusing the uscis by sending 824 to another place different than vermont ??

will they delay my 485 decision by sending my file to another place but vermont office?

i thought that every thing will be in one place vermont officesince i am vawa approved

am i doing bad to my self by filling 824 ? should i wait till i am green card holder ?

i am scared

please help me
