I-130 sent back for Revocation and revoked no NOIR

Timeline

You definitely need an experienced lawyer who has handled revocations successfully.

I agree with Hypnos, there is a chance that the P6C marker can become a hard finding for fraud but it is strange that a
NOIR was not send to you, perhaps an oversight of the service center ?
Let a lawyer sort it out and let him request a FOIA and request a NOIR. You won't know the legalese to get this done yourself

and will risk a permanent ban if you do.

NVC Received : some dinkelsberry yehoo in the house of clingons send our petition to the wrong consulate.

Consulate Received : July 30,2014 Transfer to right embassy complete.

Interview Date : Oct 22, 2014

Interview Result : AP , requesting another PC (not expired) and certified divorce decree (was submitted)Stokes interview via phone for petitioner 4 hrs after interview.

Oct 23 email notification visa approved.
Visa Received : Nov. 3 , 2014 VISA IN HAND.

US Entry : Nov. 21, 2014

Marriage : Dec 27, 2014

AOS send : May 12, 2015, received May 14, 2015 USPS priority

Email &text : May 18, 2015, check cashed May 19,2015, return receipt May 21, 2015 stamped USCIS Lockbox, NOA1 (3x) May 22,2015

Biometrics : June 1, 2015 letter received for appointment June 8, 2015, successful walk-in June 1, 2015

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Emails : Aug 24, 2015, EAD approved, EAD card ordered.

I-797 EAD/AP approval notice received : Aug 27, 2015

EAD/AP combo card mailed : Aug 27, 2015, EAD/AP combo card received: Aug 31, 2015

EAD/AP (renewal) approval Aug 22, 2016, NOA2 received Aug 25, 2016

Renewal EAD in production notification text and online, expedite successful 4 days after RFE request response was faxed, Aug25mailed,Aug29received.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

Can i ask what questions were asked at interview?

How and when did you meet?

When was the last time and how many times did he visit Ethiopia?

Do you have a bank account together?

What is his demeanor like?

When did he get his citizenship?

Were there red flags in your relationship?

First time we met we got married 12 days latter and I was there for a month.

I haven't been back since the marriage which was 9 months to the interview.

He asked how long were our conversations on average and my wife said an hour to 45 min, when they were actually 5 to 20 mins.

What kind of evidence did you present with your I-130 petition?

Photos of wedding, random pics during my stay with her.

money transfer receipts

Marriage certificate.

Did you present more at interview?

No.

Was there AP after interview?

No.

So you submitted no chats, emails, texts, Skype?

The questions the CO asked are very odd and specific. Like your demeanor. Do you have a facebook account? Do you two share it how is your posting? They do check those out for some.

Seems her answers don't line up with some things. Like I said I have never seen an out right revoke without a petitioner given a chance to address the denial points,

Get the FOIA, get with a lawyer and see what your next steps maybe.

So, I have some updates I went and saw a lawyer and he said it was odd they did not send me an NOIR sinces the reason my wife was denied was lack of evidence. We filed an I-290B motion to reconsider/reopen and submitted an affidavit from me and the additional evidence I would have submitted had I received an NOIR. The I-290B was received July 23 and three months latter this is what my status says.

Post Decision Activity

On October 23, 2014, we received your appeal of a negative decision made on your I130, IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN. After reviewing the information you have provided, we have decided to reopen or reconsider your case and are now actively reviewing it. No further action is required on your part at this time. You will receive a decision by mail once the review is complete. If you have not received notification within 30 days of the date above, please call customer service at 1-800-375-5283 for further assistance. If you move, please use our Change of Address online tool to update your case with your new address.

For approved applications/petitions, post-decision activity may include USCIS sending notification of the approved application/petition to the National Visa Center or the Department of State. For denied applications/petitions, post-decision activity may include the processing of an appeal and/or motions to reopen or reconsider and revocations.

Does this look good? By them reopening it means they lean my favor? Could they have rejected be for reopening it?
