Hello, I am a US Citizen with a spouse and child from Australia. I have filed A I-130 for my spouse and its currently at the NVC. The child was born not too long ago. I know he can have US Citizenship but we may go back to Australia after a few years. Is there a visa i can file for him to bring him with his mom or do i have to file a seperate I-130. Thank You.

If the child has claims to US citizenship he will not be granted any visa.

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

No, no other way. As stated a visa is not issued to those with claims to US citizenship. If you plan on moving to Aus. in the future, look into dual citizenship for the boy.

So there's no other way to bring him?

There is only one legal way for a US citizen to enter the US; carry a US passport.

File for the CRBA and a US passport.

The US Embassy will not and legally can not issue a visa to a US citizen.

Your child is a US citizen, so you need to hop through the CRBA and US passport hoop.

No. US citizens are not entitled to visas, because they do not need them. They need passports. A baby that is a (potential) US citizen will not be given a visa; this issue often holds up travel, so get it sorted now.
