My husbands I130 was approved but when he went for interview, his case was denied because of an overstay in the US from ages 18-22. He was brought into this country by his parents when he was 10, didnt really have a choice. We had moved to Canada when he turned 22 since his sister was there but Canada deported him after 4 years. He is now back in his country of Colombia, where he has no immediate family and is unsure of this new lifestyle. I am trying to bring him back to the US where he grew up and graduated high school, but doing this alone has been hard. I was wondering if any one had any advice on the waiver? I dont know if I should get a lawyer to help or not? I have done everything else on my own, but this part is overwhelming me. I just want my husband back. We have been separated since March 2013. I finally went and saw him this past week for 6 days, but felt unsafe in Colombia the entire time. Any advice?

Did he get an approval letter at the embassy to file waiver/s?

Get a waiver atty to do the rest of the process its not a DIY

matter, will cost money & takes time, but doable since its only

an overstay, and hardships have to be addressed in a brief

with evidences...Liz Cannon can be googled a good waiver atty.

There are some good waiver attorneys.

Essentially, you need to show why it would be a hardship for you, the USC, for your husband not to be in he USA. And no, just missing him is not enough... you need to show that you cannot move to his country or a third country. For example- why was he deported from Canada? How did you feel unsafe in his country (can you show police reports, news reports etc showing significant crime?).

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

There is an assumption that there is just the illegal presence to be overcome, but that may not be all.
