Hi everyone. So it was about a year ago when my foreign boyfriend filed for a visitor visa to accompany his father on a visit to his uncle's in the US. At the time we were not sure if we would see each other on that visit since the time he would be visiting for would be so short. He had all the paperwork needed and an invitational letter from his uncle. We also did not put down on the form that I was his girlfriend, because it only asked for family and a fiance, if there was one. When my boyfriend went to the consulate with his father, the officer denied him a visa, but gave his father one. The reason for this was because my boyfriend apparently did not prove enough that he would return to his country, even though the officer did not look over any of the documents.

Now, a year later, we are going to get engaged. I want to bring him here on a fiance visa so that we can marry in the US but he is fearful that because he didn't report me as his girlfriend for the visitor visa that they will deny him and bar him from ever coming to the US.

My question is, is this really something we should worry about? In my mind, we did not do anything fraudulent because he was not going to visit me in the first place and he was going to return to his country at the end of his visit to his uncle's. Plus, if the officer had asked, my boyfriend would have said yes, he did have a girlfriend who lived in the US.

Can they really deny him just because of that one thing?

Nothing to worry about. The Tourist visa Denial will have no effect on the K-1 Visa request. The only way it would have an effect is if he were denied a tourist visa because of material misrepresentation which is NOT the case here. If he had lied about why he wanted a tourist visa AND he had been caught in the lie then the situation would be different. He was honest on the application for his tourist visa. Nothing to worry about.

The only way it would have an effect is if he were denied a tourist visa because of material misrepresentation which is NOT the case here. If he had lied about why he wanted a tourist visa AND he had been caught in the lie then the situation would be different. He was honest on the application for his tourist visa. Nothing to worry about.

He's afraid that they will assume he had lied on the tourist visa, and accuse him of wanting to come see me instead. I'm thinking they can't do that. Can they?

No they can't. Being penalized on an immigrant visa petition for be g denied a previous visitor visa because of immigrant intent logically does not even make sense... So no worries for,that... Carry on

Do not worry about it. Many people have been denied a visitor visa and then go one to do the K1. My husband ( then fiance) was denied a visitor visa twice. He was not asked anything about it during the K1 interview.

I was denied on B-2 visa back in 2010 and during the interview they never asked one single question about my past denial on my tourist visa application.

There was no requirement to declare he had a girlfriend in the USA. That denial will not impact his future K-1 visa application.
