So me and my partner are about to go through the AOS process. I just want someone who has also been through this, or is in the process to check and see if we have it right? :idea:

We are filing the I-485 and the I-130 at the same time.

So we have put together the package and it looks something like this

I-130 Package

- G-1145 e notification

- Cover letter

- Form 1-130

- USC birth certificate (front and back)

- UK birth certificate

- UK full passport copy

- Certified copy of our marriage certificate

- G-325A biometrics USC

- USC passport style photo

- G-325A UK citizen

- UK citizen passport photo

+ All our documentation proving the marriage is bona fide

I-485 Package

- G-1145 e notification

- Form I-485

- Copy of UK citizen passport

- electronic I-94

- UK citizen birth certificate

- Certified copy of marriage certificate

- G-325A biometrics UK citizen

- 2 Passport photos

- I-693 Medical examination

- I-864 Affidavit of support + Co-Sponser Affidavit of support

- I-765 (Employment)

From what status are you adjusting? This information will help us put your thread in the best forum.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

The most common RFE is for mistakes on the I-864. You have a co-sponsor so what evidence are you including?

You also need 2 photos for the I-765, and I take it you don't want to apply for I-131?

With the I-864 we have the co sponsors tax returns from the most recent year. No I don't want to apply for I-131. Does everything else look right?

True, but sometimes VJ is not updated.

The i130 instructions doesn't say you need to add it. just send whatever they ask for in the instructions

If you file i 485 with i130, you will have to add those document anyway :)

I-130 Petition For Alien Relative

• Copy of US Citizen’s passport

• Copy of beneficiary’s passport (ID page, F-1 Visa, I-94) (No need to put your birth certificate just your passport copy)

• Copy of marriage certificate ( no need to be certified)

• G325A signed by US Citizen

• G325A signed by beneficiary

• Passport photo of US Citizen (attached with a paper clip to Form I-130 and signed)

• Passport photo of beneficiary (attached with a paper clip to Form I-130 and signed)

• Evidence of Bona fide Marriage

I-485 Application To Register Permanent Residence Or Adjust Status

• Copy of Birth Certificate with English translation

• Copy of beneficiary’s passport (ID page, F-1 Visa, I-94)

• 2 passport photos of beneficiary (attached with a paper clip to Form I-485 and signed)

• Form I-693 Report of Medical Examination and Vaccination Record (Completed by a Civil Surgeon sealed in an envelope)

• G325A signed by beneficiary

• Copy of I-20 Form

• Form I-864 Affidavit of Support

• Sponsor's proof of U.S. citizen status

• Sponsor's tax return (2011-2013) and pay stubs

With the I-864 we have the co sponsors tax returns from the most recent year. No I don't want to apply for I-131. Does everything else look right?

Then you are missing things.

1. Correct I-864 documents for petitioner/sponsor, like completed form and tax return. If no tax return was filed, letter of explanation.

2. Proof of USC or LPR for co-sponsor.

3. Proof of current employment for co-sponsor.

4. Make sure the tax returns are complete or get tax transcripts instead.
