Hello all,

After 11.5 months of waiting our I 130 petition for spouse, is finally approved and on its way to NVC! Woohoo! However I have a questions that's been driving me crazy. Can my husbands previous denial of a Student Visa back in 2012 along with a Visitors Visa denial the same year affect the outcome of our I 130 interview. He was denied under section 214 (b) and the officers told him that he didn't have enough financial ties back in his country. He never lied to an officer. I have a lawyer who is assuring me that everything will go smoothly. However I want some extra opinions and answers.

I would actually be interested in this too, as my wife was also denied a student visa in 2012.

I-130 1st i-797(NOA-1): 12 November 2013, Vermont (Dis-)Service Center (1 day in transit)

I-130 2nd i-797(NOA-2): 30 May 2014, Vermont (Total Dis-)Service Center (199 days in USCIS hell)

I-30 Received at NVC: 11 June 2014 (11 days in transit)

NVC Case # Assigned: 27 June 2014 (15 days to case number assigned)

DS-261 Completed: 15 July 2014 (18 days to DS-261 available)

AOS Fee Bill Paid: 17 July 2014

AOS Fee Bill Shows "Paid": 22 July 2014

AOS Package Sent Out:23 July 2014

AOS Package Recieved: 28 July 2014

I would actually be interested in this too, as my wife was also denied a student visa in 2012.

I was denied a student visa twice before and I had no problems at my K-1 visa interview. They are going to ask why the visa got denied though so just be honest.

I was denied too on my first attempt for a tourist visa back in 2008. and I had no issues with it. For a K-1 like me, it will be asked in the DS-160 if I was refused a US visa before. I answered yes. The embassy will be able to find out about the details on their own anyways. So just always be truthful.

Being denied on visitor's visa or student visa will not be an issue. But do be upfront and truthful about it. They will have the records with them anyway.
