Hi All:

I'm starting to budget (I'm a plan ahead-er) for all of the immigration forms, and I've read the guides for post K-1 (even though I am not yet). While I get all of the fees for the K-1 Process, can anyone tell me what this mystery fee is for in my notes or if I'm mistaken?

Post K1 entry and Post marriage, the beneficiary now spouse of petition files:

I-485 (Permanent Residence/AOS) + I-765 (Employment) + Biometrics = $1070.00

on the "After K1 / AOS" Guides here, those are the forms it lists, along with some optionals like Advanced Parole.

But on my budget I also have this listed: "Immigration Form = $420" in addition to all those above. In my digging, I found on USCIS that the I-130 Petition for Alien Relative costs that exactly, but does the K1 Petitioner have to file that in conjunction with the Beneficiary's I-485 after the marriage? Or is this just a mystery cost?

Anyone who can help me understand my own weird notes would earn my eternal gratitude!

A person adjusting from K-1 and marriage to the petitioner within 90 days does not file a I-130. Just the I-485 set, based on choice C in the eligibility section, part 2.

If I am correctly understand your question, there is no additional fee for AOS besides $1070 and no need to file I-130 after marriage within 90 days. People who come here with a tourist visa and then married or if K-1 visa holder married the petitioner beyond 90 days, they have to file I-130 along with I-485. Do you mind to tell me where the fee in your budget is come from originally?

After POE of a K-1 (and wedding, of course), you're right, it will be $1070 for AOS + Biometrics. Both EAD and AP costs will be waived if applied concurrently with AOS.

HA! That's exactly what I want to know! After doing a ton of research back in January, I wrote up a budget based on all the forms. This "Immigration Form = $420" was just on there--now I'm wondering where I even got that number and that form FROM. I figured I didn't have to fill out a I-130, but I was trying to see if the $1070 was all the fees (not that that's a small amount, it's a lot! But now I'm suspicious as to why this is on my budget list....)

Thanks for your assurance, everyone! I did check the AOS/Post K1 guides, and found nothing--so I figured I just made a mistake months ago. Though if anyone remembers what to pay $420 for that isn't on this list (or that may be pre-K1 Approval) please let me know! :)

I can see how that can happen. There are two main ways to AOS discussed on this board, and people in either camp just call it "AOS." You may have stumbled upon a list for a non-K-1 AOS and wrote down what was in it.
