I'm new, and have a question about The Affidavit of Support (AOS). The threshold for my husband to sponsor me is around 19K. On his last years tax return he made less than this. Does that mean that our application will be denied? What is his new job pays 20-30K a year? Do they base it on current income levels or from tax return. We haven't filed the I-130 becuase of this issue.

If his new job meets the requirements then be sure to enclose pay stubs and/or a letter from his employer stating his wages or salary.

File your i-130 now. You don't need the AOS documents just yet. The USCIS will receive your i-130 petition and it will be approved in 5-9 months depending if you get an RFE or not. After your i-130 petition is approved your file is sent to the NVC.

Once the NVC receives your file it is now an application for immigrant visa. That is when they will request your AOS documents and Immigrant visa documents.

Yes, he is the only one who has to sign the affidavit of support as long as he did not have someone else sponsoring you. The rest of documents u have to sign when indicates applicant signature. Good luck

when it indicates applicant on the I-130? We can't seem to figure out who signs what on the I-130

The I-130 never indicates "applicant" any place on the form, because it is not an application. It is a "PETITION". The I-130 calls the US Citizen the "petitioner" and the foreign spouse/relative is the "Beneficiary". It is the US Citizen's petition in behalf of you. The "petitioner" signs where the form indicates 'petitioner signature. Make sure the US Citizen's information is on the left side of the first page, any the foreigner's information is on the right side. At the top of page two, the petitioner's name should appear as the spouse of their foreign relative.

Thank you so much for this information. I am going to visit next month and we were going to fill the forms out together and send them in. The information that I'm learning in this community makes me feel confident we will fill them out right (this time), and also that I don't need a lawyer! I thought we would have to wait a full year for a better tax return. This is such good news :) :)

Only the self employed need to use income from a tax return as "current income". Assuming your spouse is "employed", his current income what he expects to earn from his JOB (not a business he owns) in the next twelve months from the time the affidavit is submitted.

The petitioner (your husband) signs the I-130. Along with I-130 you have to send the Biographic Information forms (G-325 A) - one for the petitioner (he signs it) and one for you (you have to sign it).

The Affidavit of Support will be needed at the NVC stage which could be 6 months or more in the future. So do not worry about it right now.

After you mail in your I-130, please complete the Timeline. Best wishes. The journey is long but worth it. Aloso now you have the VJ family to support you and cheer you all the way.
