Hello,

So last year my wife only worked for about 6 months (we graduated in May, got married in August) and made 19 thousand. I wrote a letter along with my I-864. That didn't matter apparently so now we need a joint sponsor.

Anyways, I have a sponsor and that's all taken care of. My question has to do with submitting the new I-864. Will I need to resubmit one for my wife so that both my sponsor and co-sponsor's forms are together?

It's these kinds of posts that worry me...

You "sent a letter." What letter? For what purpose? Is she working now?

Generally current income is what counts, so if you documented it properly then you would not have a RFE. I suspect the issue is not your income, per se, but your documentation. If your documentation is not sufficient, then they send a boilerplate RFE that says "income not good enough." You need to pay attention to the first part of the RFE instead.

If you fail to provide the correct evidence then they will deny your AOS.

I fear my original post was lacking. I had sent all her W-2's, tax returns, tax transcripts and copies of her pay stubs. In addition to all that, I had written a note which explained that she only made that much money because she only worked 6 months. I thought they would extrapolate...especially since I sent proof of current income.

That's fine though, but do I need to send another I-864 from my wife when I send the one from my co-sponsor?

I think if they kept her original I-846 then just send the co-sponsor, but if they had also returned your wife's I-864 then I would send the original back along with the co-sponsor.

For the current annual income, Part 6 #5, what did you put? Did you only put the $19k made in those last 6 months? If so, that is the issue. Writing a note about it won't help. Her current annual income should have been listed as what she is currently earning in a year's time. So, her hourly pay rate times how many hours worked per week and then multiplied again by 52 weeks. That would be the current annual income amount to use. You supply a letter from employer and/or most recent pay stubs to prove that income amount.

They will not look at the income amount listed, read a note and sort through your papers figuring out that she does indeed meet the income requirement, and that the current income amount listed was actually incorrect. You need to state everything correctly on the forms, provide the documentation to prove what you put on the form and even highlight and point out the important info they need to see on your supporting documentation.

I would send an updated I-864 and income documentation along with your joint sponsor's documentation. Write an explanation and make a statement with your RFE response that you believe you meet the income requirement and ask they they recheck your updated documentation before considering the use of your joint sponsor. Highlight that statement and your income proof evidence. They may, or may not pay attention to that request.
