Visa Denied

After a year I finally heard about our visa.

We were denied because they think we our in a sham marrige. I have until April 16th to sumit evidence to prove our marrige is legit. I have about 300 pictures from my June trip to Ukraine and 700 from my trip in Dec. and Jan. The problem is my wife was never married to her son's father. She is listed as a single mother on his birth certificate. Somehow the CO thinks the name on her paper work is her married name. Her birth certificate has the same name she uses now and it is the same as her passports. Her son has her last name. She had to replace her passport in 2006 and the CO thinks she did this to hide the fact she had been married(never married before me). My lawyer wants some kind of proof of the fathers name. Trying to prove a negitive. I hope some of you can help me find a way to get around this. Phil

My wife is the only parent listed on her adopted sons BC since the father legally signed away all his rights prior to the birth.

Photos are not proof of a relationship, you should know that.

Why is the fathers name not on the BC?

To prove your relationship draft a letter titled Evolution of Our Relationship. In this you will describe how you came to meet and how your relationship followed the normal course of a relationship from getting yo know you to agreeing to meet to something more then agreeing to marry and then wanting to live together. All The while you will reference then many and varied evidences that support each stage (I assume you do have these ?, if not then you may be up a creek!)

I believe in Ukraine, you can get a certificate of no father or something along those lines. It is not an uncommon practice in Ukraine, from what I know, so it is strange they are so suspicious.

Have you tried talking to ZAGS (or whatever the Ukrainian equivalent of ZAGS is) to see if they could get you some apostilled proof she has never been married?

An update. Finished my reply to USCIS about our marriage. With my lawyers brief and all my proof the packet was over 300 pages. Mailed Saturday USPS overnight with a deliver of 3pm Monday. I hope they have fun reading all the email, skype logs and letters from my family and her friends.

Now I wonder how long I have to wait for a reply.

Woman's saying who is father of her child is not a proof from legal point of view if it's not supplemented by legal documents like birth certificate, court resolution with DNA test or something else.

USPS SUCKS. Overnite Express mailed April 12 from Williamsburg Va. to St. Albans Vt. with a guarantee delivery of Monday April 14th by 3pm. Still not there. Package ONLY contained paper work for my wife's visa. Due April 16th. Should have drove it up myself. Big deal I get my money back. Because of the mess up this will cost me several thousands dollars United States Postal Service SUCKS.....

USPS SUCKS.

I feel sorry that it happened, but can't resist to mention that you probably have never had to deal with Russian Post. If your letter made it within a week to the next state it's great, because it can lay in some post facility for a week or so before anybody will even touch it... if it will not end in the trash by mistake. I'm here for 2 years but still can't believe how amazingly UPS and USPS work comparing to Russian Post.

It does suck. However, it takes time for USPS and the other services to get anything inside the service centers (or, the service centers take time to receive anything from those services), and you'd never have been able to hand-deliver anything. Rest assured that we feel for you very empathetically, and we fervently hope for a positive outcome. Keep the faith, si man.
