my husband filed for I-130 and k3, also filed our child on a k4. is it true that when our 2 year old child come to US she will be an automatic US citizen?

The father of the child is the petitioner?...the US citizen?...If yes, the child was a US citizen already

Is the USC the bio dad? If so, you can file a consular report of birth abroad at the embassy and get the child a US passport without waiting. No need for the child's visa then.

I highly suggest also filing an I-130 for the child since a K3 visa is very rare. The child will not be able to immigrate if the visa is changed to an IR1 or CR1 visa (:time:) and there is not an approved I-130 for them.

I don't think u need to file for a visa for your child especially when the Father is the USC, the Petitioner. All u need to do for ur child is apply for CRBA at the Embassy, then they will give her the US Passport...a US passport is all she need not any visa..

I don't think u need to file for a visa for your child especially when the Father is the USC, the Petitioner. All u need to do for ur child is apply for CRBA at the Embassy, then they will give her the US Passport...a US passport is all she need not any visa..

Not everyone qualifies for the CRBA. There are a list of qualifications.

K3 visas are VERY VERY rare. They happen about 0.33% of the time. If your I-130 is approved and reaches the NVC before or at the same time as an approved I-129F, the NVC will close your I-129F and you will be on the IR1/CR1 path, not the K3 path. That means there will be NO K4 visa and your child will not have a visa to travel to the USA with. That also means more time because you'll have to file an I-130 for the child and wait for it to be approved and sent to the NVC to join the two petitions.

It is USCIS policy to adjudicate the I-130 and I-129F together

It is NVC policy to close the I-129F if it reaches the NVC at the same time or after an approved I-130.

K3 visas are VERY VERY rare. They happen about 0.33% of the time.
