Hello,

I just want to make sure I understand something. If my wife and step-daughter are here visiting on their tourist visa after I have filed the I-130 for each of them, and we decide to file a I-485 for AOS while they are here, am I required to pay the I-485 fee for my wife and a separate I-485 and fee for my step-daughter? Thanks in advance for your feedback.

If you are applying for an IR1/CR1 visa how is your wife planning on visiting you on a tourist visa? I'm pretty sure CBP would pick up on that.

If you are already married and your wife is outside of the US then you have to go the IR1/CR1 route and that doesn't require an I-485.

If you file two petitions, you have to pay for each of them - why you wouldn't ?

On a serious note, which I do take this very seriously, I am only trying to educate myself as much as possible with the real knowledge and feedback of the people here on VJ, so that I am informed and ultimately make the best decision with the options on the table.

If you file two petitions, you have to pay for each of them - why you wouldn't ?

For the same reason if I had chosed to go with the I-129F route I would not have to file two of them...the child is included on the one one I-129F form and you don't pay two fees. That's why I ask some of these questions, to ensure I have a full understanding, pay what I am supposed to, and not pay what I don't need to.

What you are proposing is not possible, either CBP won't let your wife and step child in the country or if they somehow do get in then USCIS is certainly going to red flag your case.

From what I understand and what I have read from other posts, many people have no problem entering the USA on their tourist visa while their I-130 in being processed. Some have been questioned a little more at POE, but the majority of posters have they didn't have any problems.

Maybe you thought when they at the POE, they say they are going to AOS, and no, I would never do that. I'm tallking about it they enter as a normal tourist with to honest intent to AOS at the time, and then if comes up as a discussion with us at a later time during their visit and we choose to AOS. Honestly, that is not our intent. I have too much riding with security clearances, etc. to do anything that would be illegal.

Wow, never got a straight answer. :ranting:

He never got a "straight" answer two years ago for this inquiry is a borderline VJ Terms of Service (TOS) violation. We all agreed to abide by the TOS when we joined the forum, http://www.visajourney.com/content/terms

The specific problem is that his line of inquiry is perilously close to asking other members to violate the TOS, which could result in administrative actions.

Condone or instruct, either directly or indirectly, others on how to commit fraudulent or illegal immigration activities in any way, shape, manner or method.

BTW, to my knowledge this is not a government website, but given the current tensions in the world, it would not surprise me to hear that the government may be monitoring this site.

Additionally, the originator of this thread has not been active in over two years.

This stale thread has run its course and is closed to further comment, and referrals to this thread should not be done.
