Hi everyone...

I am alittle confused with our CEAC status... so i wrote my case no. and 2 status appear....

if you click the submit.. it automatically shows..

ADMINISTRATIVE PROCESSING and it is updated everyday...

However, there are 2 status... at the bottom, it also says REFUSED with the same date. so when every i click the status at the bottom.. thats the status that show on the main status.. and both has the same date and both are updated everyday.

I do not know what real status is.. if we are under AP or REFUSED...

during the my interview, we got the section 221(g) due to lack of documents.. i passed the lacking docs. and waited for a week now.. i called the embassy and told us that the recent documents i said isn't still enough and unfortunately we got refused.

im not sure whats up with our case now. the AP and REFUSED status in our CEAC status appeared before i sent in the lacking documents. now, its still see the 2 statuses after i called... but the date are all updated everyday.

I can anyone help me? who has the same situation? which is really my status right now? the refused or the AP? I'm so confuse.. help.... should i believe on the 1st that says CASENO###### 01? or CASENO###### 02?

Are you the beneficiary? Just contact the US Embassy. My fiance just called them to get clarification and they were able to help him a lot.

I also sent them an e-mail a few days before my fiance called, and I got a reply within 10 days.

By the way, my fiance "called" through Skype. That's free. :)

Yes i am the beneficiary. we called and email them as well. we still did not get anything. i called yesterday but the lady was not in the mood.. my fiancé called as well but still told us that we got refused still under section 221g after passing the supporting documents.. they did not give us any other detail and said they will send us an email. they still have my passport.. i just really want o know if we are under AP or we are really refused and we can do nothing but move on...

I don't have any direct experience or knowledge on the subject, but there's a good explanation of a 221g here; http://www.visarefusal.com/221g/

Technically, 221(g) is considered a denial; in subsequent visa applications and registration in the Electronic System for Travel Authorization, this must be disclosed. Nevertheless, the overwhelming majority of 221(g) denials are overcome and visas issued.

21 Sep 2013 - Filed i-129F

27 Nov - NOA2 email received (63 days since NOA1)

30 Jan 2014 - NOA2 sent to NVC (64 agonizing days) P.S. Apparently VJ doesn't care about accurate timelines.

11 Feb - Got Case number

24 Feb - Packet 3 Received and Submitted

25 Feb - Packet 4 Received and Submitted

29 Apr - Medical (Dr Cheema)

01 May - Vancouver Consulate Interview - Approved!

06 May - Visa in hand!

06 June - Entered the USA!

14 June - Married!

yes, it is true a refused visa is basically a denied visa... but what I'm confused about is.. i have 2 statuses which is refused and administrative processing... both same date.. I'm not sure which category we are in.

so confused right now because iif we are really refused. they still did not give me any notice or explanation that we are refused for the 2nd time. and i am confused because they still have my passport with them.

The Visa is classified as "refused" while administrative processing is going on. Once they finish doing whatever it is they're doing, it will hopefully be approved, but you're stuck waiting to see if, or when that will happen.

i just hope its administrative processing than "refused"... we were refused at first because they wanted to see my fiancé w2 2013. we were lacking some documents. but we already sent it the lacking documents. and now, she lady yesterday said we are still refuse because my fiancé did not reach the poverty guideline still. in sufficient income. so i don't know what will happen next..

its really heart breaking.. i just need some advices on what we can do.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Did your fiance submit a tax return and W-2 showing at least that income? If not... did you try using a co-sponsor? I know USEM can be difficult with co-sponsors for the K-1, first and foremost co-sponsor it must be a relative, but even then no guarantees.

From everything I read from your postings you were refused a visa because of inadequate income, is this correct?

The petitioner's income must meet the poverty guidelines of the I-864P for himself, you and your daughter. For three people that is $24,412.

Did your fiance submit a tax return and W-2 showing at least that income? If not... did you try using a co-sponsor? I know USEM can be difficult with co-sponsors for the K-1, first and foremost co-sponsor it must be a relative, but even then no guarantees.

Yes, I guess we are denied a visa. Acceptance is a the key now... Anyway... They still have my passport... It's been 2 weeks.. So, I'm just a waiting for them to return it. And mayb give me a formal letter that states that we are really denied now and there is nothing we can do... :)

Yes there is.. Actually I had their affidavit of support with us during interview.. But they told me they don't accept co sponsorship with k1 visa

I actually sent my fiancé fathers co-sponsorship... I'm still hoping for a positive outcome... Because when we called the embassy and when they told us it's refused, the lady said they will return my papers and passport with in the week.... How ever, my ceac status says administrative processing and untill now I did get my papers and passport... It's been a week now..
