HELP needed with AP

Hi everyone,

I entered the US in October, got married early November and then about 2 weeks after that sent in the forms for AOS/EAD/AP.

We got RFE 2 times about our AOS.

They received the AP and EAD november 26th, and they have been on initial review since then..

So now it has been 71 days.

Our plan is to have our wedding ceremony in Finland in May, and thats why I want to get my AP as fast as possible so I can leave in april and send invitations,get all the planning ready etc..

Is it possible that they would deny the AP? Why is it taking so long??

It depends what your RFE's were for, if they were for initial evidence required for the I765 process then they can completely reset the 90 days for the EAD or if it was for additional evidence they can suspend the time from when the RFE was issued until it was accepted, as it stands you are still within the original 90 days so at this stage you are still within normal processing times.

AP takes up to 90 days. It has been 71 days. Plus all the time you had RFEs, your whole case was paused. Add that time on to the 90 days.

They got our last response to RFE december 31st.. So that really affects also the AP and EAD processing?

We got RFE because first the check was wrong, then later we had to send my husbands birth certificate and more info about his taxes.

If the check was wrong, that was not a RFE, but a flat-out rejection. Did you receive all the papers back?

nah - many times they send a letter with an invoice to pay, and not send the whole casefile back

there were not other glaringly obvious things missing at the lockbox review.

Okay, so what you are calling your "first RFE" was in fact a rejection. At that point you had not been put in line at all.

Whenever you sent your papers back, and then got an NOA1, that is your "start date." It should be on your acceptance papers. Then you got a RFE (about BC), and any time between them sending it and them receiving it back does not count either, your case was paused.

What is the date of acceptance on your NOA1?

And Darnell, they don't hold papers and wait for a check at a Lockbox. Too confusing.

I have only got one NOA1 since sending in the AOS/AP/EAD package, it says they received our stuff november 26th. I mean I got 3 NOA1's at the same time, but they sent a separate one about aos and ap and ead. I never got any other NOA1's.

But when i track my case status online, my AOS processing status changed December 31st to "request for evidence response review". I also had my biometrics appointment already January 3rd.

EAD and AP status on the website has been on initial review since November 26th.

An estimated average time to get approval for you EAD/AP is right around 65-70 days from your NOA1 -- it's currently been 70 days for you BUT you had an RFE so your time will be a bit longer, due to everything being put on "hold" while you dealt with those issues. So add however many days it took you to submit the RFE material to the 70 day estimate, and you'll get SOME idea of when you'll see EAD/AP approval.

We had no RFEs and got our EAD/AP in 66 days. I suspect yours will be coming very soon, unless there is a further RFE that they find lacking.

How are you now? Do you get your AP now?

I still havent received my AP. We called the National Benefits Center last week, and they said RFE's for AOS does not have an effect on the AP. But ya dont know about that!

On Sunday it will be 90 days since they received my AP/EAD, so I will call them on Monday and see what they can do about it.
