Hello All!

We submitted an I-130 at the beginning of January 2014. Now my husband's employer said they would bring him over by an L1 visa (which is much faster I hear).

Has anyone had this happen in the past... where you submit an I-130 and are in process but now would like to go for a different visa, L1, in this case... do you need to cancel your I-130/CR1? or can you continue with your I-130/CR1 visa?

I don't think the L1 leads to a permanent visa so should we continue with the I-130/CR1? or do a change in our I-130?

Wait for the i-130.

You'll have a green card in 10 months (worst case).

Just leave the I-130 going (respond to any RFE).

L-1 is a dual-intent visa, so he can enter the US with the intent to both work and adjust his status on L-1. Once he is in the US, you can file an AOS package to become a Permanent Resident. The I-130 will be a part of this package. If it gets approved before you are ready to do the AOS, then just leave it and don't do anything with NVC. Once you apply for AOS, you will send a copy of the approval notice. Or, if it is not yet approved, you can file AOS with a copy of the NOA1 from the I-130 to show it's been paid for an it's in progress.

I have no information about L1, but I just wanna point out that this is not true. My I-130 has been submitted over 7 months ago, still no NOA2/RFE. 10 months looks like the best case at this point, not worst.

I have no information about L1, but I just wanna point out that this is not true. My I-130 has been submitted over 7 months ago, still no NOA2/RFE. 10 months looks like the best case at this point, not worst.

For them its the embassy of the Netherlands. Faster processing and interview date -- even with a 7-8 month approval for the i-130.

They could have a L-1 in a few weeks and the company pays for it. And the couple lose no money. What's the problem?

They could have a L-1 in a few weeks and the company pays for it. And the couple lose no money. What's the problem?

If they go the DCF route its less than 6 months.

If they go the regular route its 10 months in the worse case.

Adjustment of Status is actually more annoying than is consular filing (I have been through the former and am now going through the latter).

If he has a Dutch Passport, he can come visit (VWP) or vice versa

If he's from the netherlands, he can come visit whenever he wants.

Ok, i get that, but why is the "regular route" 10 months?. It is 7-9 months for the i130 alone on the regular route? plus 3-6 at the NVC/Consulate. IS the netherlands special then? I am from the UK (London apparently being a very lax/large consulate) and i am hoping for anything under 12-13 months put perhaps looking at 15-16 worse case

Ok, i get that, but why is the "regular route" 10 months?. It is 7-9 months for the i130 alone on the regular route? plus 3-6 at the NVC/Consulate. IS the netherlands special then? I am from the UK (London apparently being a very lax/large consulate) and i am hoping for anything under 12-13 months put perhaps looking at 15-16 worse case

Well... im one of those few who believe CIS when they say the wait will be reduced to 5 months by May :D

I would go L-1, make it a part of the contract that his firm deals with ALL the immigration for the family - soooooo much easier - thats what i did when we went to Hong Kong (Although that immigration process is like "you have a UK passport, here is your work visa")
