naptime as I explained before VAWA unit adjudicate Vawa cases ,once approved they ship to local office, then after a few days ship to the NBC,and then go to the local office again. The local office will adjudicate the AOS.

luoboy considering what you said your denial can be because you didn't prove bonafide marriage, abuse, commune residence and good moral character. Maybe you were denied in one ground,maybe two, or all grounds. I believe was denied because you couldn't prove bonafide marriage,abuse and commune residence.Of course submitting a psychological evaluation will help to prove abuse,but when refiling Vawa you must submit prove showing bonafide marriage/abuse and commune residence as well. Having 2/5 people swearing you had a bonafide marriage it helps a bit, but it doesn't mean they will approve your case just because of the affidavits. Your own affidavit is the most important piece in the whole Vawa case.

Taking in consideration what you said, your case was terrible handled.You got RFE because you were not able to prove bonafide marriage,abuse,commune residence and good moral character, then submit an appeal for what?.

The Law is clear YOU CANNOT FILE AR 11 to change address for I-360(Vawa),it must be NOTARIZED letter and you have to sent it to VAWA Unit.You made a mistake filing out form AR11,what abuse are you talking about in your" Jurisdiction"? it was your mistake calling them and filing AR 11.My two cents here, you proved already you can't do by yourself your case,you need a lawyer,period. You are the first person in 15 years that i handle Vawa cases that I heard USCIS issued RFE for all 4 grounds,it means you didn't know how to handle a Vawa case.Find a pro bono lawyer to represent you,

Like biometrics appointment letter? If it is the black and white letter you talking about (not the yellowish, official, imprinted letter that you get as receipt or acceptance of your case) I took my copy too because I lost my original one,(was in different folder and I couldn't find it before appt ) and I make copies of papers as soon as I get them from immigration office. They didn't even look at it closely just at the beginning to confirm my name and the date, and then they stamped it in red after taking my pic and finger prints. I still have the paper. This is my experience, idk if it would be different for somebody else, maybe Sandraj might shed a light

Yes, i do not have the original biometrics appointment letter, I have a copy(black&white), will this be a problem at the biometrics appt?

Sorry folks i was using my phone when Ianswered to Luoboy,and I realized now that I misspelled some words,my bad lol

So finally I got a job today which will for the time being help me cover my monthly expenses...Also I was trying to be a smart ### and I went to DMV to give my written...I flunked ;-)..lol...Any VJ members out here in CA?

Hello everyone! Cielo congratulations on your interview :-)

I had my interview yesterday. It started a little late, I heard somebody didn't go and everyone else were doing that person's interviews. It lasted about 15-20 minutes. It was a very serious man the IO, he got a little upset that I didn't have a receipt from my rent or my lease contract with me. :-S ( I didn't know I was supposed to bring it with me) he started asking when did I met my ex husband and when did the abuse started he kept going through out the complete file, back and forth. I knew he wasn't suppose to ask about the abuse but honestly he looked so strict and intimidating that I thought I didn't want to get him upset, plus even though I don't like to think about what happened when you have told the truth there's nothing to be afraid of. He asked what I did and were I went after a flee. He asked if I had put a restraining order on him, he asked me what had happened about a picture of a bruise that I had sent... He asked when did we get married, he asked if my ex was violent to our son, he asked to see my id, passport, my son's birth certificate and the divorce decree, I didn't take a copy but I had in my mind leave that copy if asked and just get another certified copy at the court house, in my county do that is not difficult. He was a bit upset that I didn't bring a copy but I explained to him that he could keep it. He asked if I was arrested, since I was, long time ago, I said yes and also that I was cleared, gave him the certified copy from court in regards to that matter. He also asked if I had a relationship with his parents and I said no and he asked why. He kept going back and forth into the file, I think all of them use red pens, he kept doing his thing into the file, I felt like a fifth grade student having a paper reviewed :-S

He asked how often does my ex husband see our son and how much child support do I receive, he asked me if I was going to school and if I am working, he asked me where do I work and what do I do there. And finally the sweetest words came out of his mouth "I'll grant you the residency " he asked if I had photos with me... I had just pictures, like the ones I had sent with the package as complement for bonafide marriage. But he meant passport pictures. That brought to his attention that he had pictures in the file, he reviewed those asked me to identify my ex husband, asked me how far apart were our ages, then he said they didn't need those pictures any more so he handed them back to me ( :-S ) - the ones I had sent to Vermont. He said again that he was granting the petition and escorted me out, half way to the hall he let me leave on my own and he returned to his office, Btw he said I should receive my card in 2-3 weeks... I don't know however if I will receive RFE for passport pictures... Well that was my experience when I received my card I'll complete my time line... But my journey started in March 2012

Tears came to my eyes reading your post citragirl I was holding my breathe to the end Praise be to God!!!!! your journey started 2 months before mines and what a journey half of which I havent even posted here but to God be the glory so happy for you!!!!!!

Islandinthesun,thanks they never asked me for anything but l feel better now am not alone but its stressful..sometimes when you call them,they put a request on your case even if they dont help .

I am waiting too missymd and Islandinthesun the IO needed to re-do my sons fingerprints since he turned 14 before the interview date. Then a week later the IO called me an ask if I can bring him in to have the fingerprintes done so my sister took him yesterday.

My spouse is an LPR so I still have to wait for visa availability since my PD is 29 May 2012 but God is good we will all get good news soon.

Thanks Sandra. This means I have to write a letter and get it notarized in order to get another denial letter mailed to me. I also want to please find out if there is anything particular I have to write in the letter. As of now I think I should just write a regular formal letter and send it express to Vermont.

About the pro bono lawyer I called some organizations and they are very busy. I am willing to pay a lawyer to handle my case. Just that I want a fair price not 15000 dollars.7500 dollars ahead is a ridiculous amount because I have no arrest record. I also want a serious lawyer who knows how to handle my kind of case. Not one who is trying to complicate it further by wanting to handle the case in removal proceedings. I do want to hire a lawyer because I took 1 month off work in Tacoma to put my first paperwork together didn't know Visa journey existed by then. When I moved back to Omaha I have been forced to take multiple days off work to answer RFEs and make appointments to consult lawyers. I missed a week off because of the trip to Chicago . I figured out if I pay a lawyer to do it then I don't have to miss work. Maybe 1 OR 2 days in a month.

August 10th 2011 - Received NOA's for all 3, fee waivers accepted
August 26th 2011 - Received EAD
Early July 2012 - Re-applied for EAD based on pending I-485
Mid July 2012 - Received NOA for 2nd EAD
August 1st 2012 - Received EAD
Silence for a few more months
October 26th 2012 - I-360 approval
November 19th '12 - Case transferred
May 2013 - Received interview notice

June 2013 - Interview (approved)

Permanent resident since June 2013

I agree with missymd, you need to relax, but you also need to make wise and calculated decisions. Taking trips to Chicago to meet lawyers doesn't sound like a wise and calculated decision that's a 7 hour drive from Omaha. $15000 is an exorbitant amount of money, and makes no sense for a vawa case. $2000 to $5000 is more likely to be what a good lawyer will charge. You shouldn't go see any lawyer without your denial letter. Like I have told you before, you need to receive that letter first to know exactly why your I-360 was denied, and go from there. I do not think writing to the senator will change anything, you need to re-file, but in order to re-file you need to know why you were denied so that you can provide more documents or information to prove your case. Right now, you need to call the shelter and find out if they sent the denial letter to your new address, and make sure to verify that they sent it to the right address.

I did call the lady at the shelter and she says the post man advised her to write forward to my new address on the envelope.I don't know if that means they have to mail back to Vermont first or it comes straight to me
