Hello!

I am applying for K-1 visa for my Fiance.

I had her fill out and sign her letter of intent to marry and g-325a, sign it, scan it and send it to me, I printed it out.

Since she is overseas its is the fastest way to get the document signed, but is it acceptable by USCIS and the US Embassies?

Thanks,

Igor

G-325A requires original signature.

Don't have it? can print on bottom, in the sig block 'Beneficiary will sign during Interview at the IV Unit'. This works, as we've had reports of it working for about 5 years now.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

Letter of intent also needs original signature, so might as well send the G-325A, letter of intent and passport photo together via some sort of express/courier mail.

Might risk getting a RFE, depend on who view your file. Some get RFE, some don't

Thanks for the replies!

I was going to get her to send via airmail. But I followed the k-1 visa guide on here and the cover letter on the bottom says:

"Copies of documents submitted are exact photocopies of unaltered documents and I understand that I may be required to submit original documents to an Immigration or Consular officer at a later date."

With that being said, can I still send the scanned documents and have her bring the originals when she goes off to the interview?

Thanks!

That really applies to official documents, such as birth certificates and divorce decrees.

Some have gotten away with using a copy of the letter of intent, and some have received an RFE for an original signature on them. It could go either way for you.

Okay I see now.

Well how long is a delay if I get an RFE? 2 weeks?

It would take around 2-3 weeks to get the documents if she sends it.

What I think I will do I will send in the copies and have her mail me the originals and if I get an RFE, by that time I will have the originals and resend it.

If scanned ones will work then good, no hassle there.

Who would be more concerned with original documents? The USCIS or US Embassy?

Thanks

No way to answer about how long of delay the RFE would make. It varies. I think in general it is safe to go with a couple weeks to a month, but that is not set in stone.

You are comparing two different things by asking who is more concerned with it. You need to provide the USCIS with required documentation for the petition first. They are the ones that will process it, and some adjudicators will send an RFE if the letter of intent does not have an original signature. This is in order to get the I-129F petition approved.

For the consulate(DoS), some require new updated letters of intent, again with original signatures. They can ask to see originals of any documents in your approved petition file, and will most likely require the foreign fiance(e) to provide an original of their birth certificate and divorce decrees(is applicable). This is in order to get a K-1 visa approval.

Phil (Lockport, near Chicago) and Alla (Lobnya, near Moscow)

Dont send your packet yet, wait for the originals papers, rfe mean delay.

So it is better send the packet with originals documents insted they send you a rfe they will approved you but if they send rfe that is going to deley

So for Divorce Decrees, is it possible to send in a cpoy, then Mail him the original to take to interview?

G-325a is no longer required.  All this information is included with the updated I-129 form.  The advantage is the G-325a signature is no longer required by the beneficiary.

So can I just send in copies of my dlife voice decree (and his translated) then send him the originals to take to the interview?  I really just need to know if I need to get an additional certified copy, or if they will take the copies first. Thanks
