Hi all, besides other things, could someone please let me know how long does it take for the form I-130 for siblings of USC to be approved? I am not interested in when my sister can get here, but just the part that I-130 form to be approved to be used for priority date. Is it 6 month? 1 year? 2 years?

The priority date is the date that USCIS received the i130. You can see that on the i797c Notice of Action form.

No one can tell you how long it takes to approve the I-130.

Some people get approved within a year while it can take 8-9 years for others.

There is no rush to approve the I-130 since it takes a long time for the PD to become current, so anytime before the PD becomes current is a time when the I-130 can be approved.

The Priority Date is when USCIS gets the I-130. The I-130 approval has nothing to do with the PD.

Thank you Aaron. Is there a site that I can do some numbers/statistics to see about I-130 approval timeline? It doesn't have to be accurate, just an estimate would be fine as in majority waits more 8-9 years vs. others a year/6 months? Where can I find such info?

What happens is you submit the I130 and you get an notice of receipt This is the important date called your priority date. If then goes into the slow approval que. Because the approval date makes no difference in the process it doesn't matter is how fast you are approved. Everything works off the receipt date. Sublings are a numerically limited visa. Only a certain number are issued each year. If you are in a normal country it is about 12 years of wait currently. A few countries have too many in line so they have a separate que. The worse is the Philippines where siblings wait 23 years for a visa. If you and I filed for siblings on the same day and they approve your petition the next day and mine is 8 years both our siblings wait 12 years from the filing date to be able to get a visa.

This will not be over quickly. You will not enjoy this.

i am aware of this. But there's my niece and I need to figure out the math to see if the child age protection status would apply to her. When it comes to that calculator, the approval of I-130 is vital. That's why I am fishing for even just an estimate from other threads so that I can do analysis on the 'average' timeline for that.

As long as your petition at USCIS take longer time for approval, then you can factor in the maximum time in calculating the cspa for your niece which might be beneficial..ClockWatch2.gif

It took 2 months for my F4 approval in USCIS. I believe it will take me at least 10-12 yrs until NVC contact me about my case. Luckily I don't have any kids or they may age out due to the early approval in USCIS

What is F4? Is that petition for siblings ? and it only takes two months for your I-130 to be approved?

Yes, F4 is the category for petition a sibling. My priority date is Nov 26,2013 and I just got my approval from USCIS California Center on Jan 29, 2014. There will be a long way to go before my case with process in the NVC.

The I-130 approval is relatively fast. It's waiting for the PD that takes years. Siblings end up taking at least 12 years (those from the Philippines usually have to wait 24 years, for example!).
